RESOLUTION 2021-66 <br />APPROVING A VARIANCE FROM THE ORDINARY HIGH WATER LEVEL <br />BUILDING SETBACK REQUIREMENT FOR PROPERTY LOCATED AT 14475 <br />FOREST BOULEVARD NORTH <br />WHEREAS, Lakeview Family Dentistry has requested approval of a variance to allow <br />the proposed addition to be setback 61.4 feet from the OHW level of Egg Lake, where <br />100 feet is required by City ordinance, on property legally described as follows: <br />See Attached <br />WHEREAS, the Planning Commission has reviewed said variance at a duly called public <br />hearing on September 23, 2021, and recommends approval with the following findings <br />and conditions: <br />1. The proposed facilities shall be in adherence to the site plan dated September 16, <br />2021. <br />2. The proposed variance is permissible by law. <br />3. The applicant is proposing to use the property in a reasonable manner. This is a <br />reasonable use of the property as it is consistent use on site. <br />4. The variance will not noticeably change the character of the area. <br />5. There are practical difficulties in meeting the ordinance standards. <br />6. The spirit and intent of the ordinance is to allow expansion of businesses and to <br />ensure that buildings are located a reasonable distance away from OHW levels. <br />7. The property is not located within a floodplain area. <br />8. The property is served by City sewer and water. <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />variance request for Lakeview Family Dentistry to allow the proposed addition to be <br />setback 61.4 feet from the OHW level of Egg Lake, where 100 feet is required by City <br />ordinance, on property located at 14475 Forest Boulevard North. <br />ADOPTED by the City Council this 4t' day of October, 202vel . �%k. <br />, may <br />ATTEST: <br />Michele Lindau, City Clerk <br />
