RESOLUTION 2021- <br />APPROVING A CONDITIONAL USE PERMIT FOR WHITE BEAR LAKE SCHOOL <br />DISTIRCT TO ALLOW A SCHOOL IN THE SINGLE FAMILY DETACHED <br />RESIDENTIAL (R-3) ZONING DISTICT FOR THE PROPERTY LOCATED NORTH <br />OF 152ND STREET NORTH AND WEST OF FOREST BLVD NORTH (HIGHWAY 61) <br />WHEREAS, White Bear Lake School District has requested approval of a conditional use permit <br />to allow a school in the single family detached residential (R-3) zoning district for the property <br />located north of 152" d Street North and west of Forest Blvd North (Highway 61).. <br />WHEREAS, the property is legally described as follows: <br />See Attached <br />WHEREAS, the Planning Commission has considered the request on March 25, 2021, at a duly <br />called a public hearing and recommends approval. <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF HUGO, MINNESOTA, that it should and hereby does approve the conditional use permit to <br />allow a school for the property located north of 152nd Street North and west of Forest Blvd North <br />(Highway 61), subject to the following findings: <br />I. The use is permissible by law. <br />2. The spirit and intent of the ordinance is to allow a school in the R-3 zoning district as a <br />conditional use. The performance standards requires the school to have its principal <br />entrance is from a state highway, county road, or city collector street. The school's <br />principal access is from Highway 61. The project meets the spirit and intent of the <br />ordnance. <br />3. The property is guided as Low Density Residential in the 2040 Comprehensive Plan. The <br />types of development anticipated to be located in this area include among single family <br />homes, schools, and trails. Elementary schools are commonly located in residential <br />neighborhoods. The Peloquin Industrial Park is across Highway 61 is which includes <br />larger industrial buildings. The school is compatible with the comprehensive plan and <br />character of the surrounding areas. <br />4. The school will have adequate drainage, water supply, electrical, gas, and municipal <br />sewer service. <br />5. The access to the school will be from Highway 61. Highway 61 is controlled by Mn DOT. <br />The applicant has been working with MnDOT and Washington County on the access <br />location and intersection improvements that will include a traffic signal and <br />corresponding turn lanes. The school has adequate road access. <br />
