Lakeview Family Dentistry <br />14475 Forest Blvd N, Hugo, MN <br />Land Use Application - Variance Request Findings <br />September 3, 2021 <br />VARIANCE FROM MAXIMUM IMPERVIOUS SURFACES <br />The existing Lakeview Family Dentistry facility is located adjacent to Egg Lake and therefore is located in <br />the shoreland district. Based on the shoreland district rules, no more than 25% of a lot or parcel in the <br />shoreland district may be covered by an impervious surface. The existing impervious surface coverage of <br />the lot is 30.6%. A variance is requested from the maximum impervious surface coverage for the <br />proposed building addition. The requested variance meets the required findings as follows: <br />(1) Law. The variance as requested is permissible by law. <br />The requested variance is permissible by law. <br />(2) Practical difficulties. The applicant for a variance shall establish that there are practical <br />difficulties in complying with the provisions of the zoning regulations. The term "Practical <br />Difficulties" as used in the granting of a variance means: <br />a. Reasonable use. The property owner proposes to use the property in a reasonable manner <br />not permitted by the zoning ordinance and; <br />The property owner proposes to use the property in a reasonable manner consistent with the <br />permitted use within the zoning ordinance and in continuation of services currently offered by <br />the business. <br />b. Unique circumstances. The plight of property owner is due to circumstances unique to the <br />property not created by the landowner and; <br />The property has unique circumstances in that the existing property exceeds the maximum <br />allowable impervious surface coverage today, thereby creating a need for a variance for any <br />expansion of the building. The property owners have exhausted all other available options to <br />avoid a variance, including attempts to acquire adjacent properties to the north and south to <br />increase the overall property area. The property owners have also spent extensive time <br />pursuing alternative options, including different properties, to avoid a variance request. The <br />proposed development of the property continues to serve the growing community, meets <br />minimum parking requirements and provides enhanced stormwater treatment. <br />C. Character of neighborhood. The variance, if granted, will not alter the essential character <br />of the neighborhood. <br />The proposed design will not alter the essential character of the neighborhood but instead will <br />enhance the development in the area. The design proposal is consistent with the current <br />aesthetics of the property and surrounding area. Hugo has continued to experience residential <br />growth, increasing demand for services in the community. Further development of this property <br />is intended to support and participate in this positive community growth. This project will support <br />the City of Hugo's development plan of the downtown district and plans for development north <br />of the property on Egg Lake.
