CONTRACTOR'S RELEASE AND LIEN WAIVER
<br />M/I Homes of Minneapolis, LLC
<br />Vendor: 2360181 C.W. Houle, Inc.
<br /> The undersigned person or entity has furnished labor, materials, or services to M/I Homes of Minneapolis, LL
<br />(“M/I”) under a contract for work on and at the premises owned by M/I, which premises is located at the address
<br />and community set forth in the invoice(s) referenced on the statement attached hereto (with all such land and
<br />improvements together referred to as the “Project”).
<br /> The undersigned, through its duly authorized agent, for valuable consideration paid, the receipt and sufficiency
<br />of which are hereby acknowledged, represents, warrants, covenants, and agrees as follows:
<br />1.With the receipt of this payment, the undersigned acknowledges payment in full of all sums due from
<br />M/I through the invoice date set forth on the statement attached herto (the "Applicable Date") in any way
<br />pertaining to the Project.
<br />The undersigned waives, relinquishes, releases and forever discharges M/I against any and all claims,2.
<br />demands, actions, causes of action, losses, damages, debts, liabilities, or obligations arising out of
<br />or in any way connected with the furnishings of labor, materials or services used in the construction of the
<br />Project through the Applicable Date.
<br />3.The undersigned waives, releases and relinquishes any right to claim or file a labor or materialmen’s
<br />lien against the Project for the furnishing of labor, materials or services through the Applicable Date.
<br />4.The undersigned warrants and represents that all persons, partnerships, firms, or corporations,
<br />including, without limitation, all subcontractors or suppliers who have furnished labor, materials or
<br />services to the undersigned used in the construction of the Project, have been paid in full or will be
<br />paid in full with the receipt of this payment and that there are no debts or obligations of any kind
<br />which are or may be the basis for a lien against the Project or the funds due the undersigned.
<br />The undersigned agrees to indemnify and hold M/I, its successors, assigns, agents and5.
<br />employees, free and harmless from and against any and all claims, demands, actions, causes of
<br />action, losses, damages, debits, liabilities, or obligations, including attorney’s fees and expenses,
<br />arising out of or in any way connected with the furnishing of labor, materials or services by the
<br />undersigned, or any subcontractor or supplier, of any tier, of the undersigned, used in the
<br />construction of the Project.
