<br /> <br /> <br /> Require compliance check decoys to be between 17 and 20 years old. <br />A state-mandated compliance check must be done at least once a year and must involve persons <br />at least 17 years of age, but under the age of 21. The proposed amended ordinance has changed <br />the language to specify the required age for decoys. <br /> Increase penalties for establishments that sell tobacco to those under 21. <br />As of August 1, 2020, state law set a minimum fine schedule for underage sales or other <br />ordinance violations by licensed tobacco retailers at: $300 for a first violation, $600 for a second <br />violation within 36 months, and $1,000 for a third or subsequent violation within 36 months. <br />Upon the third or subsequent violation within 36 months of the first violation, state law requires <br />a suspension of at least seven days and allows for license revocation. <br />The fee schedule adopted by Council on December 20, 2021 has raised the fine amounts to the <br />minimum required by state law and changed the subsequent violations to be those occurring <br />within a 36-consecutive month period instead of 24-consecutive month period, as required by <br />law. <br /> <br />RECOMMENDATION <br /> <br />Staff recommends Council approve the attached revised tobacco ordinance. <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />
