RESOLUTION 2021-3 <br />APPROVING A CONDITIONAL USE PERMIT AMENDMENT FOR VICTOR <br />LAND HOLDINGS, LLC, TO ALLOW A CAMPUS DEVELOPMENT ON THE <br />PROPERTY LOCATED AT 13676 FENWAY BOULEVARD NORTH <br />WHEREAS, Victor Land Holdings, LLC, requested approval of a conditional use permit <br />amendment to allow a campus development on the property located at 13676 Fenway <br />Boulevard North, and legally described as follows: <br />Lot 1, Block 2, Roy Molitor 4"' Addition <br />WHEREAS, the Planning Commission has reviewed said conditional use permit at a duly <br />called public hearing on December 16, 2021, and recommends approval subject to the <br />conditions listed in the conditional use permit. <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />conditional use permit amendment for Victor Land Holdings, LLC, to allow a campus <br />development on the property located at 13676 Fenway Boulevard North, subject to the <br />conditions listed in the conditional use permit with the following findings and conditions: <br />1. Campus developments are allowed in the Business Park (BP) zoning district with <br />a CUP. The use is permissible by law. <br />2. The proposed use is consistent with the Business Park (BP) zoning of the <br />property. <br />3. The proposed campus development would be compatible with the City's <br />Comprehensive Plan and the character of the area. The campus development <br />allows for a more efficient use of the property with shared access, parking, <br />circulation, and stormwater management. <br />4. The site has adequate facilities to serve the campus development, including shared <br />stormwater management and access to municipal sewer and water. <br />5. The site has adequate access to Fenway Boulevard. <br />6. The property is not located within a floodplain. <br />7. The proposed use will not have materials swept downstream. <br />8. The site is not located adjacent to public waters. <br />9. The property is not located within the shoreland overlay district and does not <br />involve watercrafts. <br />10. The property is not located within the shoreland overlay district. <br />
