Tennyson Variance <br />Page 4 <br /> <br /> <br /> 4 <br />within any designated regulatory floodway if any increase in flood levels during the base flood <br />discharge would result. <br />A portion of the property is located within a FEMA designated floodplain. The reconstructed <br />accessory building will not be located in this area. <br />(6) Septic and Well Compliance. The sewage treatment system and water system of the subject <br />property is in compliance with city and state codes. <br /> <br />Septic and well are already on the property. <br /> <br />5. CONCLUSION: <br /> <br />It is in staff’s opinion that the applicant meets all requirements necessary to approve the shoreland <br />and front yard setback variance requests. <br /> <br />6. STAFF RECOMMENDATION: <br /> <br />Staff recommended approval of the variances to allow the following: <br /> <br />1. A building setback to be 6.9 feet from the Ordinary High Water (OHW) mark of Sunset <br />Lake, where 100 feet is required by ordinance. <br />2. A building front yard setback to be 19.8 feet from the front property line, where 40 feet is <br />required by ordinance. <br /> <br />7. BOARD OF ZONING RECOMMENDATION: <br /> <br />At its Thursday, February 24, 2022, meeting the Board of Zoning held a public hearing and <br />considered the request. There was no one that spoke during the public hearing except the applicant. <br />Staff recommended approval of the variance requests. The Board of Zoning agreed the requests <br />met the standards necessary to approve the variances and unanimously recommended approval to <br />the City Council. <br /> <br />ATTACHMENTS: <br /> <br />1.
