<br />16. Special Provisions. The Agreement is subject to the following special provisions <br />which shall survive closing and delivery of any deed herein: <br /> <br />(a) Option Right to Repurchase. Seller shall have the right to repurchase the <br />Property on the 15th, 20th and 25th anniversaries of the date hereof by giving <br />Buyer three years’ written advance notice of said election to repurchase. <br />The repurchase price shall be at the Purchase Price set forth in paragraph <br />two hereof, increased by 3% per year on an annually compounded basis. <br />Said compounding to occur only after the 7th year following this Agreement. <br />Should the seller exercise their right to repurchase the property the City and <br />the District will work together to identify a suitable potential replacement <br />site. <br /> <br />(b) Use of Community Room. Buyer shall allow Hugo and its guests and <br />invitees continued exclusive dominion and use of the community room on <br />the Property. The purpose is to ensure open and ongoing use of the room <br />for community purposes., It would be made available to community groups, <br />the school district and the public for events, activities, celebrations, etc by <br />the city, with reservations and scheduling handled by City staff. The City <br />will adopt a policy acceptable to it for prioritization of use. The City will <br />provide janitorial services for the room. The City may choose to <br />maintain/replace or upgrade furniture and add A/V equipment or other <br />amenities to the room. The School District will pay electricity, as the room <br />is not metered separately and furnish at all times utility service to the room. <br />The School District will not pay a fee to use the room. <br /> <br />
