SEPTIC EASEMENT This Septic Easement (hereinafter “Easement”), made this ____ day of ________________, 2022, by and between the City of Hugo, a municipal corporation under the laws of Minnesota (“Grantor”); and Independent School District No. 624, White Bear Lake Area Schools, a public school corporation under the laws of Minnesota (“Grantee”). WHEREAS, a septic system is located on Grantor’s property, which system serves a building located on Grantee’s property, which is adjacent to Grantor’s property. WHEREAS, Grantor agrees to convey to Grantee an easement as further described herein and Grantee agrees to accept said Easement according to the terms and conditions contained herein; and WHEREAS, said Easement provided by the Grantor does not convey ownership of lands within the easement area to the Grantee. NOW THEREFORE, in consideration of mutual covenants herein, and other good and valuable consideration, the sufficiency of which is hereby acknowledged, the parties agree to as follows: TERMS OF EASEMENTS 1.) Grant of Easement. Grantor grants and conveys to the Grantee the Easement legally described in Exhibit A and depicted on the attached Exhibit B. 2.) Scope of Easement. The perpetual non-exclusive Easement granted herein includes the right of the Grantee, its contractor, agents, and employees to reconstruct, operate, maintain, inspect, alter and repair within the described easement, a septic system that serves Grantee’s adjacent property. The Grantee is responsible for maintenance of the septic system. 3.) Warranty of Title. The Grantor warrants it is the owner of the Property and has the right, title, and capacity to convey it the Grantee the easements herein. EXHIBIT D
