SEPTIC EASEMENT <br />This Septic Easement (hereinafter “Easement”), made this ____ day of <br />________________, 2022, by and between the City of Hugo, a municipal corporation <br />under the laws of Minnesota (“Grantor”); and Independent School District No. 624, <br />White Bear Lake Area Schools, a public school corporation under the laws of Minnesota <br />(“Grantee”). <br />WHEREAS, a septic system is located on Grantor’s property, which system serves a <br />building located on Grantee’s property, which is adjacent to Grantor’s property. <br />WHEREAS, Grantor agrees to convey to Grantee an easement as further described <br />herein and Grantee agrees to accept said Easement according to the terms and conditions <br />contained herein; and <br />WHEREAS, said Easement provided by the Grantor does not convey ownership of lands <br />within the easement area to the Grantee. <br />NOW THEREFORE, in consideration of mutual covenants herein, and other good and <br />valuable consideration, the sufficiency of which is hereby acknowledged, the parties <br />agree to as follows: <br />TERMS OF EASEMENTS <br />1.) Grant of Easement. Grantor grants and conveys to the Grantee the Easement <br />legally described in Exhibit A and depicted on the attached Exhibit B. <br />2.) Scope of Easement. The perpetual non-exclusive Easement granted herein <br />includes the right of the Grantee, its contractor, agents, and employees to <br />reconstruct, operate, maintain, inspect, alter and repair within the described <br />easement, a septic system that serves Grantee’s adjacent property. The Grantee is <br />responsible for maintenance of the septic system. <br />3.) Warranty of Title. The Grantor warrants it is the owner of the Property and has the <br />right, title, and capacity to convey it the Grantee the easements herein. <br />EXHIBIT D
