RESOLUTION 2022-33 <br />APPROVING PRELIMINARY PLAT FOR M/I HOMES MINNEAPOLIS/ ST. <br />PAUL, LLC, FOR "THE SHORES OF ONEKA LAKE" ON PROPERTY <br />LOCATED EAST OF HIGHWAY 61 AND NORTH GOODVIEW AVENUE <br />NORTH <br />WHEREAS, M/I Homes Minneapolis/St. Paul. LLC, has requested approval of a <br />preliminary plat to allow approximately 218 residential lots and 10 outlots on the 131.66 <br />acre property legally described as follows: <br />(See Attached) <br />WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly called <br />Public Hearing and recommends approval, and; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />request by M/I Homes Minneapolis/St. Paul. LLC, for a preliminary plat, subject to the <br />following conditions: <br />1. A preliminary plat is approved to allow the creation of approximately 218 residential <br />lots and 10 outlots. The development shall be constructed in accordance with the <br />application and plans received by the City on October 22, 2022, April 5, 2022, April <br />19, 2022, April 28, 2022, and May 4, 2022 except as amended by this resolution. <br />2. Approval is contingent upon City Council approval of a rezoning to PUD for the <br />approximately 132 acre property. <br />3. The preliminary phasing plan is generally approved per plans dated October 21, 2022, <br />revised May 4, 2022. Any major revisions to the phasing plan shall require PUD <br />amendment. Minor modifications shall be reviewed and approved by staff. <br />a. Phase 1 shall include: <br />i. Permit shall be issued by MnDOT for construction of the <br />roundabout at 159a' Street and Highway 61. <br />ii. Start of construction of the roundabout at 159a` Street and Highway <br />61. <br />iii. The developer is responsible for the cost and construction of the <br />roundabout at 159th Street and Highway 61. The Letter of Credit <br />for Phase 1 shall include the costs for construction of the <br />roundabout. <br />b. Phase 2 shall include: <br />i. The roundabout at 159 h Street and Highway 61 shall be <br />constructed and functioning, with the first layer of bituminous, <br />prior to issuance of a building permit for the 1 st building. <br />ii.
