BWSR NOD Form – November 12, 2019 3 <br />applicant is proposing to replace these impacts through the purchase of 1.06 acres of wetland credit from <br />Bank #1722. Wetland Bank #1722 is located in the same major watershed and BSA. No wetland credits are <br />available in the same minor watershed as the impacted wetland. <br /> <br />Special Considerations <br /> <br />The applicant has addressed and submitted information on each of the special considerations identified in MN <br />Rule 8420.0515. These include: <br /> <br />• Endangered and threatened species <br />• Rare natural communities <br />• Special fish and wildlife resources <br />• Archeological, historic, and cultural resources <br />• Groundwater sensitivity <br />• Sensitive surface waters <br />• Education or research use <br />• Waste disposal sites <br />• Consistency with other plans <br /> <br />The applicant has submitted documentation from a NHIS desktop assessment using data from January 2021. <br />The review resulted four (4) element occurrences (EOs) within or overlapping a one-mile buffer of the project <br />site. Three (3) of the four (4) Eos were for Blandings Turtle (state threatened) and one (1) for Trumpeter Swan <br />(State Special Concern). Suitable habitat for Blandings Turtle does occur within and adjacent to the Goodview <br />Estates project area. <br /> <br />Three (3) native plant communities (NPCs) occur within the project site, but none of the three (3) meet the <br />statutory threshold of imperiled or critically imperiled, and as such do not require additional protections <br />based in the NPC ranking values. <br /> <br />The supplemental memo from Bopray Enviornmental, dated April 5, 2022, indicates that the applicant is not <br />aware of any additional issues related to the special considerations listed above. <br /> <br />Based on the application submitted along with supporting materials, the application for sequencing and <br />wetland replacement is approved with conditions. Sequencing flexibility is also approved as the replacement <br />wetland credits would result in a gain in function and public value and avoidance of wetlands B and C would <br />result in severe degradation of the wetlands ability to function due to surrounding land uses. <br /> <br />1 Findings must consider any TEP recommendations. <br /> Attached Project Documents <br />☒ Site Location Map ☒ Project Plan(s)/Descriptions/Reports (specify): See above <br /> <br />Appeals of LGU Decisions <br />If you wish to appeal this decision, you must provide a written request within 30 calendar days of the date you <br />received the notice. All appeals must be submitted to the Board of Water and Soil Resources Executive Director <br />along with a check payable to BWSR for $500 unless the LGU has adopted a local appeal process as identified <br />below. The check must be sent by mail and the written request to appeal can be submitted by mail or e-mail. <br />The appeal should include a copy of this notice, name and contact information of appellant(s) and their <br />representatives (if applicable), a statement clarifying the intent to appeal and supporting information as to why <br />the decision is in error.
