BWSR NOD Form – November 12, 2019 3 applicant is proposing to replace these impacts through the purchase of 1.06 acres of wetland credit from Bank #1722. Wetland Bank #1722 is located in the same major watershed and BSA. No wetland credits are available in the same minor watershed as the impacted wetland. Special Considerations The applicant has addressed and submitted information on each of the special considerations identified in MN Rule 8420.0515. These include: • Endangered and threatened species • Rare natural communities • Special fish and wildlife resources • Archeological, historic, and cultural resources • Groundwater sensitivity • Sensitive surface waters • Education or research use • Waste disposal sites • Consistency with other plans The applicant has submitted documentation from a NHIS desktop assessment using data from January 2021. The review resulted four (4) element occurrences (EOs) within or overlapping a one-mile buffer of the project site. Three (3) of the four (4) Eos were for Blandings Turtle (state threatened) and one (1) for Trumpeter Swan (State Special Concern). Suitable habitat for Blandings Turtle does occur within and adjacent to the Goodview Estates project area. Three (3) native plant communities (NPCs) occur within the project site, but none of the three (3) meet the statutory threshold of imperiled or critically imperiled, and as such do not require additional protections based in the NPC ranking values. The supplemental memo from Bopray Enviornmental, dated April 5, 2022, indicates that the applicant is not aware of any additional issues related to the special considerations listed above. Based on the application submitted along with supporting materials, the application for sequencing and wetland replacement is approved with conditions. Sequencing flexibility is also approved as the replacement wetland credits would result in a gain in function and public value and avoidance of wetlands B and C would result in severe degradation of the wetlands ability to function due to surrounding land uses. 1 Findings must consider any TEP recommendations.
