Easement Vacation Public Hearing and <br />Encroachment Agreement for the Property Located at 4635 Ethan Trail <br />North <br />DAT E: July 27, 2022, for the City Council Meeting of August 1, 2022 <br />ZONING: Single Family Detached Residential (R-3) <br />LAND USE: Low Density Residential (LD) <br />60-DAY REVIEW DEADLINE: August 26, 2022 <br />1. DESCRIPTION OF REQUEST: <br />The applicant is requesting a vacation of a portion of the existing drainage and utility easement <br />located over a property located at 4635 Ethan Trail North. The lot has existing drainage and <br />utility easements on the property that were dedicated as part of the Prairie Village 3rd <br />Addition final plat. The applicant is installing a pool on the property. There is a 15 foot <br />drainage and utility easement in the rear yard of the property. They inquired about vacating a <br />portion of the rear yard easement in order to place the pool at the setbacks allowed per the <br />swimming pool ordinance. The Senior Engineering Technician reviewed the request and <br />determined that the easement could be vacated 5 feet. Staff is comfortable with the applicants <br />requests to vacate 5 feet of the drainage and utility easement in the rear yard of the property. <br />The applicant is also requesting an encroachment agreement for a fence that is located in the <br />easement area. <br />2. RECOMMENDATION: <br />Staff recommends that the City Council approve the notice to vacate a portion of the drainage <br />and utility easement and approval of the encroachment agreement.
