Variance <br />request from the rear yard and side setback requirement and for an <br />addition to an attached garage. Variance request for the attached garage to <br />exceed the square footage allowed. <br /> <br />DATE: August 11, 2022, for the City Council Meeting on August 15, 2022 <br /> <br />ZONING: Rural Residential (RR) <br /> <br />REVIEW DEADLINE: September 18, 2022 <br /> <br /> <br />1. BOARD OF ZONING UPDATE: <br /> <br />At its Thursday, August 11, 2022, meeting the Board of Zoning held a public hearing and <br />considered the request. Staff presented the information and recommended approval of the <br />variance application. There were two residents that spoke during the public hearing. One had <br />concerns about the addition and wanted the addition to meet the setback requirements. He spoke <br />about other problems he has had with neighbors in the past. The other did not live directly <br />adjacent to the property and generally stated he was not impacted by the request, but spoke about <br />another situation at his former residence where a neighbor of his was running a business. <br /> <br />The Board agreed the application met the criteria to approve the variance request. The Board <br />unanimously recommended approval of the variance request subject to the condition in the <br />resolution. <br /> <br />2. DESCRIPTION OF REQUEST: <br /> <br />The applicants are requesting variances to construct a 1,120 square foot addition to their 1,350 <br />square foot attached garage. There are three variance requests. The first request is to allow 2,470 <br />square feet for the attached garage, where 1,113 square feet is allowed by ordinance. The second <br />request is to allow the rear yard setback to be 35 feet from the property line, where 40 feet is <br />required by ordinance. The third request is to allow the side yard setback to be 12 feet, where 20 <br />feet is required by ordinance.
