RESOLUTION NO. 2022- A RESOLUTION ORDERING THE PROJECT AND AUTHORIZING THE PREPARATION OF PLANS AND SPECIFICATIONS FOR THE 2023 BIRCH TREE PONDS AREA STREET IMPROVEMENTS WHEREAS, pursuant to resolution of the Council adopted July 5, 2022, a report was prepared by WSB, with reference to the improvement of the Birch Tree Ponds subdivision streets including Foxhill Avenue North, 138th Street North, Geneva Avenue North, 135th Street North, 135th Court North, Freeland Avenue North, Freeland Court North, and Fountain Ave north and south of Egg Lake Road; and WHEREAS, the following improvements are proposed:  Partial road reconstruction for Foxhill Avenue North, 138th Street North, Geneva Avenue North, 135th Street North, 135th Court North, Freeland Avenue North, Freeland Court North, and Fountain Ave north of Egg Lake Road.  Mill and overlay improvements on Fountain Ave south of Egg Lake Road. WHEREAS, the City intends to assess benefited properties for a portion of the aforementioned improvements, pursuant to Minnesota Statutes, Chapter 429, and WHEREAS, the City Council has received and accepted the feasibility report prepared by the City Engineer on October 17, 2022, for the 2023 Birch Tree Ponds Area Street Improvements; and WHEREAS, a resolution of the City Council adopted on the October 17, 2022, fixed a date for the Council public hearing on the proposed improvements; and WHEREAS, ten days' mailed notice and two weeks' published notice in advance of said public hearing was given and the hearing was held thereon on November 21, 2022, at which time all persons desiring to be heard were given an opportunity to be heard thereon. NOW THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF HUGO: 1. Such improvement is necessary, cost-effective, and feasible as detailed in the feasibility report for the 2023 Birch Tree Ponds Area Street Improvements. 2. Such improvement is hereby ordered as proposed in this Council resolution adopted November 21, 2022. 3. The improvements described in the notice of public hearing and the feasibility report are hereby designated and shall be known as the 2023 Birch Tree Ponds Area Street Improvements. 4. The City Council shall authorize WSB to prepare plans and specifications of said improvements. 5. The City Council shall let the contract for all or part of the work for said improvements or order all or part of the work done by day labor or otherwise as authorized by Minnesota Statutes, Section 429.041, Subdivision 2 within one year of the date of this Resolution ordering said improvements.
