RESOLUTION 2022-XX <br /> <br />APPROVING A CONDITIONAL USE PERMIT AMENDMENT FOR XCEL <br />ENERGY TO AMEND THE SITE PLAN FOR THE PROPERTY LOCATED AT <br />13620 FENWAY BOULEVARD NORTH <br /> <br />WHEREAS, Xcel Energy has requested approval of a conditional use permit amendment <br />to amend the site plan for the property located at 13620 Fenway Boulevard North and is <br />legally described as follows: <br /> <br />(See Attached) <br /> <br />WHEREAS, the site plan is in accordance with the variance to allow transmission <br />training poles to be up to 105 feet in height, where 50 feet is required by ordinance. <br /> <br />WHEREAS, a conditional use permit was approved on April 5, 2021, for a new <br />transmission line for training. <br /> <br />WHEREAS, it is the desire of the applicant to amend the conditional use permit approved <br />on April 5, 2021, to revise the permit and to supersede all other prior conditional use <br />permit approvals. <br /> <br />WHEREAS, the Planning Commission has reviewed said conditional use permit <br />amendment at a duly called public hearing on November 10, 2022, and recommends <br />approval subject to the conditions listed in the conditional use permit. <br /> <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />conditional use permit amendment for Xcel Energy on the property located at 13620 <br />Fenway Boulevard North with the following findings: <br /> <br />1. The development shall comply with the revised site plan dated November 7, 2022. <br /> <br />2. The developer shall provide overstory deciduous trees and shrubs to substitute the <br />minimum requirement of ornamental trees by City ordinance, in the respective <br />amounts specified by the landscape plan dated August 5, 2022. <br /> <br />3. Prior to the issuance of a building permit, exact locations of new facilities and <br />final project plans shall be reviewed and approved by staff. <br /> <br />4. The developer shall comply with all items in the conditional use permit and it will <br />be recorded at Washington County. <br /> <br />ADOPTED by the City Council this 21st day of November, 2022. <br /> <br /> <br /> <br /> _______________________________ <br /> Tom Weidt, Mayor <br />ATTEST: <br />
