Page 1 <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />(Above Space Reserved for Recording Information) <br /> <br />STORMWATER RE-USE LICENSE AGREEMENT <br />(Premier Hugo MN, LLC and AFLP Hugo MN, LLC, Hugo, Minnesota) <br />THIS STORMWATER RE-USE LICENSE AGREEMENT (this "Agreement") is <br />entered into as of this ______day of____________, 2023, by and between the CITY OF HUGO, <br />a Minnesota municipal Corporation (the “City”) and Premier Hugo MN, LLC & AFLP Hugo, <br />LLC, a Minnesota limited liability company (the “User”), owner of (the Plat of Hugo <br />Gardens______________), Washington County, Minnesota. <br /> <br />RECITALS <br />Whereas: <br /> <br />A. The City desires to allow stormwater to be pumped via the Distribution System <br />(hereafter referred to as the Distribution System and described on Exhibit A using <br />utility easements with the Plat of __Hugo Gardens______________ and supplemental <br />drainage and utility easements dated ________) to provide irrigation water to the User. <br /> <br />B. The User operates a private Irrigation System (hereafter referred to as the Irrigation <br />System) irrigating the turf areas on the property, and desires to utilize some of the <br />stormwater provided by the Distribution System for non-potable irrigation purposes <br />as set forth herein and is the owner of property identified on Exhibit B. The City is <br />the holder of certain utility easements identified on Exhibit C. <br /> <br />NOW, THEREFORE, for valuable consideration, the receipt and sufficiency of which <br />is hereby acknowledged, the parties agree as follows: <br /> <br />1. Use of Stormwater. The City hereby permits the User to utilize stormwater from the <br />Distribution System to provide irrigation water subject to the terms and conditions of this <br />Agreement.
