LETTER AGREEMENT <br />FOR _______________ EASEMENTS <br /> <br />M/I Homes and the City of Hugo has indicated their intent to acquire easements from Industrial <br />Utilities, _________________, (hereinafter referred to as “Grantor”), for the purpose of <br />constructing a fence, gates, sanitary sewer service, watermain service, and entrance connection to <br />parking areas as depicted on Exhibit A on that portion of Grantor’s properties in the City of Hugo, <br />County of Washington, State of Minnesota. <br /> <br />Grantor hereby grants permission to M/I Homes and the City of Hugo to enter upon Grantor’s <br />property as shown on the attached Exhibit “A” and made a part of this agreement, and grant a <br />temporary easement for constructing the fence, gates, sanitary sewer service, watermain service, <br />and entrance connection to parking areas, <br /> <br />Grantor conveys the Temporary Easements subject to the following requirements: <br /> <br />1. The City will ensure signage is added as pedestrians approach Owner’s access along 159th <br />Street from the east and west that indicate trucks hauling at entrance. <br />2. The City will ensure the developer installs a 4-ft chain link fence along Industrial Utilities <br />property along TH 61 and include a rolling/sliding manual gate in the place indicated by <br />Industrial Utilities. The City will ensure the developer will modify the existing 4-ft fence <br />along the future 159th Street to accommodate the installation of the new entrance that will <br />include a rolling/sliding manual gate. The City will also ensure the developer install 100 <br />feet of 6-ft chain link fence along the east Industrial Utilities property line extending from <br />the north property line. The existing gate located at your existing entrance will be removed <br />as part of the project and provided to Industrial Utilities. Temporary easements will be <br />required to allow access to install these fences and Industrial Utilities shall depict where <br />they are to be placed. Industrial utilities will be responsible to temporarily relocate any <br />stored equipment or materials that are in the way of fence construction in advance. <br />3. The City will ensure that the developer construct two 24-ft driveway paved driveway <br />entrances to the property line as shown in the construction plans, with one being located at <br />Owner’s southern parcel and the other being located off of the future 159th Street in <br />accordance with the approved plans. Temporary easements will be required to allow the <br />connection of these access drives to Industrial Utilities existing parking lot. Trees, brush <br />and unsuitable material will be removed and replaced with granular compactable material <br />and 10” of class 5 product. Industrial utilities will be notified when this work is taking <br />place to witness soil conditions. No tree or brush restoration shall be done. <br />4. The City will ensure the developer constructs 159th Street to a 10-ton section allowing <br />access to Highway 61 without seasonal load postings up to your entrance pursuant to plans. <br />5. City will ensure the developer extends 8” watermain and 8” sanitary sewer into your <br />property at the proposed 159th Street entrance to Industrial Utilities. Watermain will be at <br />a depth of 7.5’ to the top of pipe and the sewer will be at a depth of 10-ft in order to cross <br />the under the watermain located in the road with required separation. Stubs shall be <br />located in accordance with approved plans.
