<br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />TEMPORARY CONSTRUCTION EASEMENT AGREEMENT <br /> <br /> <br /> THIS TEMPORARY CONSTRUCTION EASEMENT AGREEMENT shall be effective as <br />of the date that the last party executes this Agreement, is made by and between Industrial Utilities, a <br />_________________, hereinafter referred to as the “Grantor,” and the City of Hugo, a Minnesota <br />municipal corporation, and M/I Homes, a ______________ hereinafter referred to as the “Grantees.” <br /> <br /> The Grantor owns the real property situated within Washington County, Minnesota as <br />described on the attached Exhibit A (hereinafter “Grantor’s Property”). <br /> <br /> The Grantor in consideration of one dollar ($1.00) and other good and valuable consideration <br />does hereby grant and convey to the Grantees, their successors and assigns, the following: <br /> <br />1. A temporary easement for construction purposes (hereinafter <br />“Temporary Easement”) under, over, across, through and upon that <br />real property identified and legally described on Exhibit B, <br />(hereinafter the “Temporary Easement Area”) attached hereto and <br />incorporated herein by reference. <br /> <br />The Temporary Easement rights granted herein shall include, but not be limited to, the right <br />to enter upon the real estate for the purpose of constructing and installing fence, rolling gates <br />(2), 8” sanitary sewer service, 8” watermain service, and constructing a connection from the <br />proposed driveway access (2) to connect to the existing parking lot, and the further right to <br />remove unsuitable soil for connection to the existing parking lot, brush, trees, undergrowth, <br />and other obstructions interfering in the location and construction of Industrial Utilities <br />requested improvements. <br /> <br />EXEMPT FROM STATE DEED TAX <br /> <br />The rights of the Grantees also include the right of the Grantees, their contractors, agents and servants: <br /> <br /> a.) to enter upon the Temporary Easement Area at all reasonable times for the <br />purposes of construction, installation, inspection, grading, sloping, and restoration <br />relating to the construction of fencing, gates, sewer service, water service, and <br />connection of access drive to existing parking lot ; and <br />
