Resolution 2023-27 <br /> The Shore of Oneka Lake 2°d Addition Final Plat and Development Agreement <br /> 8. The developer shall establish a property owners association for the development to <br /> own/operate/maintain common elements, monument signage, landscaping, and the water <br /> re-use system. The property owners association documents shall be reviewed and <br /> approved by staff prior to recording the plat. <br /> 9. The landscaping planned for the plat shall be installed in one phase. The developer shall <br /> take proper precautions to protect the trees as the homes are being built. <br /> 10. Each home shall include a minimum of 2 parking spaces within the driveway. The <br /> driveway widths shall be a maximum of 24 feet at the right of way line. <br /> 11. Staff will continue to work with the applicant on the street lighting plan. Exact locations <br /> of the street lights shall be reviewed and approved by staff prior to installation. <br /> 12. When needed, a Letter of Map Revision will need to be prepared and submitted for <br /> FEMA approval so that the existing floodplain boundaries and elevations can be revised <br /> per the plans. <br /> 13. The developer shall obtain all necessary local, state, and federal permits. <br /> 14. The property owners association shall be responsible for maintenance of all development <br /> signage(if any) and landscaping within the outlots, common space, and the 159th Street <br /> roundabout. <br /> 15. Prior to recording the final plat: <br /> a) The developer shall provide letter of credits for the development improvements and <br /> round-about improvements. The developer shall provide an escrow to the City for the <br /> roundabout improvements with the bids are received by the City, plus contingencies. <br /> All fees outlined in Exhibit C shall be paid. <br /> b) The plans shall be revised to remove proposed development for Outlot C. No <br /> development approvals are implied or approved for Outlot C. <br /> c) The developer must obtain all necessary stormwater management and wetland <br /> conservation act(WCA) permits from the City. <br /> d) The developer shall pay $28,322 ($2,023/lot) in full to satisfy the required cash in lieu <br /> of parkland dedication requirement. A portion of the Park Dedication was previously <br /> satisfied by dedication of 3.89 acres of upland on Outlot G. <br /> e) The developer shall pay the sewer and water trunk fees for each lot at final plat. The <br /> City's SAC and WAC fees will be paid at the time building permits issued. <br />
