PROPOSED MOTION: <br /> <br />Move approval of the attached notice vacating the drainage and utility easements located over <br />12796 Ethan Avenue North. <br /> <br />2. DESCRIPTION OF REQUEST: <br /> <br />The property is located in the Woods of Bald Eagle Development on the shore of Bald Eagle <br />Lake. The property is 1.93 acres in size with approximately 1.29 acres of wetlands. The City <br />maintains drainage and utility easements over the wetlands on site. The applicant, Raj Alexander, <br />completed a new wetland delineation in 2023 that adjusted the boundary of wetland from the <br />previous delineation, creating a new portion of upland on the property that was previously <br />delineated as wetland. <br /> <br />The applicant is requesting vacation of the portion of easement that lies over this upland <br />previously thought to be wetland. The easement vacation will allow for the applicant to have <br />enough space to construct an accessory building. Staff is comfortable with the applicant’s request <br />to vacate the drainage easement. <br /> <br />3. RECOMMENDATION: <br /> <br />Staff recommends that the City Council approve the notice to vacate the drainage easement <br />located over 12796 Ethan Avenue North. <br /> <br /> <br />
