<br /> <br />The Shores of Oneka Lake 3rd Addition 9 <br />approval is given subject to the following requirements: <br /> a) Expiration. The final plat documents for the Plat, which is the first <br />phase of The Shores of Oneka Lake preliminary plat, have been submitted to the City Council <br />within one hundred twenty (120) days of preliminary plat approval. The final plat must be recorded <br />with the Washington County Recorder (and the mylar "hardshells" must be fully executed) within <br />sixty (60) days of the City Council motion giving final plat approval, unless such deadline is <br />extended by the City Council in its sole discretion, or else said approval shall be null and void. All <br />fees relating to this subdivision shall be paid by the Developer, including the cost of recording <br />documents with Washington County. <br /> <br /> b) Recording. The Developer shall record this Agreement with <br />Washington County simultaneous with the recording of the Plat, and shall forward confirmation of <br />recording of the Plat and this Agreement to the City prior to the issuance of building permits. All <br />applicable conditions of Plat approval must be met before any deeds are stamped for recording and <br />prior to the recording of the Plat at the Washington County Recorder's Office. Plat approval shall <br />be contingent upon compliance with the approved plans for the Improvements and upon <br />compliance with this Agreement. <br /> <br /> c) Model Homes. The Developer shall be entitled to two (2) building <br />permits, subject to final approval by the Community Development Director, and under the <br />following conditions: <br />• The plat shall be recorded at Washington County <br />• The Development Agreement shall be executed and recorded at Washington County. <br />• All corresponding documents shall be reviewed and recorded per the Development Agreement. <br />The development fees per Exhibit C shall be paid. <br />• The building permit shall be for model homes only. <br />• Building permits will be allowed at the end of an existing dead-end road. <br />• All public utilities are installed adjacent to the model homes. <br />• The construction entrance shall be stable and approved by the City Engineer. <br />• The City will not snow plow the construction road. The developer will be responsible for the <br />snow plowing. <br />• Gradations (3 minimum) on the aggregate base placed on the roadway adjacent to the model <br />homes will be performed 48 hours before pavement installation. Material must meet Class 5 or <br />salvaged/recycled material meeting Class 5 gradation per MnDot Specification 3138. Aggregate <br />base that no longer meets Class 5 gradation must be replaced before pavement is installed. <br />• No Certificate of Occupancy for model homes or other homes shall be issued until all public <br />improvements, including first lift of bituminous pavement, per the final plat construction plans <br />have been constructed and inspected. <br /> <br />Other Models Homes and Homes Constructed for Sale <br /> No other model homes may be constructed or utilized until at least one (1) lift of bituminous has
