Resolution 2022- <br /> Page 2 <br /> 9. PUD flexibility is granted to allow flexibility on the following: <br /> a. Shoreland regulations <br /> b. Parking regulations <br /> c. Rear setback regulations <br /> 10. The preliminary phasing plan is generally approved per plans dated March 18, 2022. <br /> Any major revisions to the phasing plan shall require PUD amendment. Minor <br /> modifications shall be reviewed and approved by staff. <br /> a. Phase 1 shall include: <br /> i. An approximately 6,888 square foot restaurant building. <br /> ii. All improvements shown in the phase 1 plan, including <br /> boardwalks. <br /> b. Phase 2 shall include: <br /> i. All improvements shown in the phase 2 plan, including and <br /> boardwalks. <br /> 11. Each phase be required to apply for PUD final plan, and other applicable applications, <br /> to be reviewed and approved by the City Council. <br /> 12. The building setbacks and impervious surface requirements for the development are <br /> as follows: <br /> Front Setback 10 feet <br /> (min) <br /> Side Setback 0 feet <br /> (min) <br /> Rear Setback 0 feet <br /> (min) <br /> Lot 46% <br /> Impervious <br /> (max) <br /> 13. The developer shall have a commercial property owners association created to <br /> maintain the common areas, including parking, lighting, landscaping, and <br /> boardwalks. The association documents shall be reviewed and approved by staff. <br />
