RESOLUTION 2022-XX <br />APPROVING A CONDITIONAL USE PERMIT FOR PREMIER BANK TO ALLOW A <br />DRIVE THROUGH BUSINESS WITHIN 200 FEET OF RESIDENTIALLY ZONED <br />PROPERTIES FOR THE PROPERTY LOCATED AT 5616 147TH STREET NORTH <br />WHEREAS, Premier Bank has requested approval of a conditional use permit to allow a drive <br />through business located within 200 feet of residentially zoned properties for the property located <br />at 5616 147th Street North, on the northeast corner of the intersection of 147th Street North and Forest <br />Boulevard North (Highway 61). <br />WHEREAS, the property is legally described as follows: <br />See Attached <br />WHEREAS, the Planning Commission has considered the request on September 22, 2022, at a <br />duly called a public hearing and recommends approval. <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF HUGO, MINNESOTA, that it should and hereby does approve the conditional use permit to <br />allow a drive through business located within 200 feet of residentially zoned properties for the <br />property located at 5616 147th Street North, subject to the following findings: <br />1. The use is permissible by law. <br />2. The spirit and intent of the ordinance is to reduce the effects of a drive-through lane for <br />drive-through businesses on adjacent residential property. The proposed drive-through <br />lane is placed in an area and the plan shows the preservation of existing trees on the north <br />property line, that would reduce the effects on adjacent residential properties, therefore <br />keeping with the spirit and intense of the ordinance. <br />3. The property is zoned Future Central Business (FCB) and is guided as Mixed-Use (MIX) <br />land use in the Comprehensive Plan. The zoning district and land use anticipates <br />commercial uses in this area. The other corners of Highway 61 and 147th Street are <br />occupied by commercial uses. The proposed use is compatible with the City’s <br />comprehensive plan and the character of the surrounding area. <br />4. The proposed use has adequate drainage, water supply, and utilities. <br />5. The property has adequate road access from Flay Avenue North. <br />6. The site is not located within a floodplain area and the project is not proposing any <br />impacts to floodplain. <br />7. The site is not located adjacent to the public waters. <br />8. The site is not located adjacent to the public waters.
