RESOLUTION 2022-XX <br />APPROVING A VARIANCE FOR XCEL ENERGY, FOR TRAINING <br />TRANSMISSION LINES ON THE PROPERTY LOCATED AT 13620 FENWAY <br />BOULEVARD NORTH <br />WHEREAS, Xcel Energy, has requested approval of a variance to allow the height of <br />training transmission lines to be up to 105 feet, where 50 feet is required by <br />ordinance on the property legally described as; <br />See Attached <br />WHEREAS, the Planning Commission has reviewed said variance at a duly called a <br />public hearing on November 10, 2022, and recommends approval subject to the findings <br />listed in this resolution. <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve <br />the variance for Xcel Energy, to allow training transmission lines to be up to 105 feet, <br />where 50 feet is required by ordinance with the following findings: <br />1.The proposed variance is permissible by law. <br />2.The applicant is requesting to construct several non-energized transmission lines for <br />training purposes that vary in height and reach up to 105 feet. <br />3.The applicant is requesting to use the property in a reasonable manner by constructing <br />transmission lines of similar height to existing energized utility poles throughout the <br />City. <br />4.The property is uniquely shaped and surrounded by mature wooded areas to the west <br />and south, screening the facilities from adjacent land uses. The wooded areas and <br />location of the proposed building would provide screening to the transmission lines. <br />The need for a variance is due to unique circumstances. <br />5.The site surrounded by other business park uses and industrial uses. Additionally, the <br />property is screened and buffered from nearby residential developments by existing <br />wooded areas and the proposed training building, therefore the requested variance <br />would not significantly alter the character of the surrounding area. <br />6.There are practical difficulties in meeting the zoning requirement. <br />7.The spirit and intent of the ordinance is to allow a certain building height without <br />adversely impacting the character of established areas and ensuring the building is <br />consistent with the surrounding development.
