Minor subdivision <br /> request to split a 20-acre parcel into two 10-acre parcels, and a variance <br /> request to allow the created parcel to the south to have a lot width of 226 <br /> feet, where 300 feet is required by ordinance. <br /> DATE: December 11, 2023 for the Planning Commission meeting of December <br /> 14, 2023 <br /> ZONING: Agricultural (AG) <br /> REVIEW DEADLINE: January 19, 2024 <br /> 1. DESCRIPTION OF REQUEST: <br /> The applicants, Larry and Louann Hanson, are requesting approval of a minor subdivision to <br /> create two lots out of a 20-acre parcel into two parcels, each 10 acres in size. The applicants are <br /> also requesting a variance from the minimum lot width requirement to have the created lot to the <br /> south be 226 feet wide, where a lot width of 300 feet is required by ordinance. <br /> 2. LEVEL OF CITY DISCRETION IN DECISION-MAKING: <br /> The City has limited discretion in approving or denying a minor subdivision application. The <br /> City's discretion is limited to whether or not the proposed subdivision meets the standards outlined <br /> in the Comprehensive Land Use Regulations. If it meets these standards, the City must approve <br /> the subdivision. <br /> The City's discretion in approving or denying a variance is limited to whether or not the <br /> proposed project meets the standards in the Zoning Ordinance for a variance. The City has a <br /> higher level of discretion with a variance because the burden of proof is on the applicant to show <br /> that they meet the standards in the ordinance. <br />
