DESCRIPTION OF REQUEST: <br /> <br />The applicants, Larry and Louann Hanson, are requesting approval of a minor subdivision to <br />create two lots out of a 20-acre parcel into two parcels, each 10 acres in size. The applicants are <br />also requesting a variance from the minimum lot width requirement to have the created lot to the <br />south be 226 feet wide, where a lot width of 300 feet is required by ordinance. <br /> <br /> <br /> <br />2. LEVEL OF CITY DISCRETION IN DECISION-MAKING: <br /> <br />The City has limited discretion in approving or denying a minor subdivision application. The <br />City’s discretion is limited to whether or not the proposed subdivision meets the standards outlined <br />in the Comprehensive Land Use Regulations. If it meets these standards, the City must approve <br />the subdivision. <br /> <br />The City’s discretion in approving or denying a variance is limited to whether or not the <br />proposed project meets the standards in the Zoning Ordinance for a variance. The City has a <br />higher level of discretion with a variance because the burden of proof is on the applicant to show <br />that they meet the standards in the ordinance. <br />
