Agenda Number: G.15 <br />CITY OF HUGO <br />PLANNING AND ZONING <br />APPLICATION STAFF REPORT <br />TO: Bryan Bear, City Administrator <br />FROM: Max Gort, Associate Planner <br />SUBJECT: Alicia Knafla– Encroachment agreement to allow a fence within a drainage and <br />utility easement on property located at 5562 130th Way North <br />DATE: April 24, 2024 for the City Council meeting of May 6, 2024 <br />ZONING: Planned Unit Development (PUD) <br />LAND USE: Low Density Residential (LD) <br />60-DAY REVIEW DEADLINE: June 11, 2024 <br />1.DESCRIPTION OF REQUEST: <br />The applicant has requested an encroachment agreement to allow construction of a fence within a <br />drainage and utility easement on property located at 5562 130th Way North. There is a storm <br />sewer pipe running across the rear of the property with a 10-foot drainage and utility easement <br />along the rear property line. Additionally, there are 5-foot drainage and utility easements along <br />the side property line. The applicant has proposed to construct the fence with a 10-foot setback <br />from the rear property line to leave adequate space for the City to access the pipe. The Senior <br />Engineering Technician has reviewed the location of the fence and is comfortable with the <br />request. <br />2.CONCLUSION/RECOMMENDATION: <br />Staff has reviewed the request and recommends that the City Council approve the encroachment <br />agreement for the property located at 5562 130th Way North. <br />ATTACHMENTS: <br />1.Location Map <br />2.Encroachment Agreement Resolution <br />3.Encroachment Agreement <br />4.Site Plan
