<br /> <br />Liberty Classical Academy 8 <br />hereto. <br /> <br />D. ADMINISTRATIVE REQUIREMENTS: <br /> <br /> 1. Miscellaneous Provisions. Developer specifically understands that this <br />Project approval is given subject to the following requirements: <br /> <br /> a) Recording. The developer shall record this Agreement with <br />Washington County simultaneous with the recording of the Project, and shall forward confirmation <br />of recording of the Project and this Agreement to the City prior to the issuance of building permits. <br />All applicable conditions of Project approval must be met before any deeds are stamped for <br />recording and prior to the recording of the Project at the Washington County Recorder's Office. <br />Project approval shall be contingent upon compliance with the approved plans for the <br />Improvements and upon compliance with this Agreement. <br /> <br /> b) Construction Trailer. The developer may be entitled to a <br />maximum of 3 construction trailers and 3 storage containers for the development for a period of <br />time not to exceed 24 months. Upon receipt of an acceptable site plan, a trailer may be approved by <br />the City Community Development Director. <br /> <br /> c) Deviations. No material deviations from the approved project shall <br />be allowed unless approved in writing by the City. Approval herein is also given subject to full <br />compliance with the conditions of approval and findings adopted by the City Council in connection <br />with the approval of the development. <br /> <br /> d) Outhouses. The Developer shall provide on-site a sufficient number <br />of portable outhouses to be available for the persons who will be working on-site until <br />Improvements are accepted according to the plans in Exhibit A. <br /> <br /> e) Developer shall remove all tree waste, junk, miscellaneous debris, <br />junk vehicles, and any other personal property from the Project which does not comply with the <br />City Zoning Ordinance until final acceptance of the Improvements. <br /> <br /> <br />E. DAMAGES AND DEFAULT: <br /> <br /> <br /> 1. Developer agrees to pay liquidated damages to the City, in the amount of <br />Five Thousand Dollars ($5,000.00), if the Developer encroaches upon any City road right-of-way or <br />utility easement not permitted on the plans without first obtaining a written permit from the City <br />expressly authorizing said encroachment.
