RESOLUTION 2024-33 <br /> APPROVING FINDINGS OF FACT FOR REZONING HW1, LLC c/o SUMMIT <br /> MANAGEMENT, LLC FOR PROPERTY LOCATED SOUTH ROSEMARY WAY <br /> AND WEST OF EVERTON AVENUE <br /> WHEREAS, HW1, LLC c/o Summit Management, LLC, has requested reclassification of <br /> the zoning from General Business (C-2) to Medium Density Multiple Family Residential <br /> (R-5). The property is legally described as follows: <br /> OUTLOT B, Frenchman Place 2nd Addition <br /> WHEREAS, the Planning Commission has reviewed the request at a duly called Public <br /> Hearing and recommends approval, and; <br /> WHEREAS, the City Council has adopted an ordinance rezoning the affected parcels <br /> from C-2 to R-5; <br /> NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br /> THE CITY OF HUGO, MINNESOTA, that it should and hereby does support the request <br /> by HW1, LLC c/o Summit Management, LLC, have requested reclassification of the <br /> zoning from General Business (C-2) Medium Density Multiple Family Residential (R-5), <br /> based on the following findings: <br /> 1. If the comprehensive plan amendment is approved, the zoning will be in compliance <br /> with the comprehensive plan. <br /> 2. The buildings and site area arranged to accommodate the proposed use in regards to <br /> parking, access, and building placement. The proposed zoning classification is <br /> appropriate for the property because there are no topographic, environmental, or <br /> cultural limitation of the site. <br /> 3. The property is adjacent and gets access from Rosemary Way. Rosemary Way is <br /> designated as a Major Collector in the 2040 Comprehensive Plan. The property can <br /> be adequately served with the accesses proposed. The property is served by city sewer <br /> and water. <br /> 4. The shopping center to the east is part of the Victor Gardens North mixed-use <br /> development that includes commercial uses and multi-family housing. Proving the <br /> mix of uses is consistent with the development in the area. The access is proposed on <br /> Rosemary Way which is classified as a Major Collector road in the 2040 <br /> Comprehensive Plan. Rosemary Way is designed to accommodate and has the <br /> capacity for additional traffic. <br />
