Memorandum <br /> <br /> <br />To: Hugo City Council <br />From: Max Gort, Associate Planner <br />Date: July 31, 2024, for the Planning Commission Meeting of August 5, 2024 <br />Re: Public Hearing – Text Amendment – Exceptions to Yard Regulations Related to Window <br />Wells/Egress Windows <br /> <br />1. PLANNING COMMISSION MEETING UPDATE: <br /> <br />At its July 25, 2024 meeting the Planning Commission held a public hearing and considered the <br />request for the text amendment relating to exceptions to yard regulations related to egress <br />windows. No one spoke during the public hearing. <br /> <br />The Planning Commission voted unanimously to recommend approval of the text amendment <br />to the City Council. <br /> <br />2. BACKGROUND: <br /> <br />Hugo City Code allows for lot line setback exceptions for several typical house features such as <br />window wells/egress windows, decks, porches, and air conditioners. In reviewing this section of <br />the code staff found that the allowance for a window wells/egress windows in the side yard to <br />encroach 2 feet into the setback requirement does not meet building code. Building code <br />requires a window well/egress window to have an opening of at least 3 feet. This issue has <br />come up in a few building permits over the last year. <br /> <br />3. STAFF RECOMMENDATION: <br /> <br />Staff recommended the zoning code text amendment to align with the building code. <br /> <br />Staff recommended the Planning Commission hold the public hearing and take all comments. <br /> <br />Staff recommended that the Planning Commission approve the text amendment for exceptions <br />to yard regulations related to window wells/egress windows. <br /> <br />4. PLANNING COMMISSION RECOMMENDATION: <br /> <br />The Planning Commission voted unanimously to recommend that the City Council approve the <br />text amendment for yard regulations related to window wells/egress windows. <br /> <br />Attachments: <br />1.
