SUGGESTED ADDENDUM TO ORDINANCE RELATING TO AND REGULATING CANNABIS <br />AND CANNABIS BUSINESSES WITHIN THE CITY OF HUGO <br />Submitted to the Hugo Planning Commission <br />Thursday, December 12, 2024 <br />Hugo City Hall, 7:00 PM <br />TITLE: <br />An addendum proposing amendments to the draft ordinance to include Cannabis Agriculture <br />Operations as a Conditional Use within Agricultural (AG) and Future Urban Service (FUS) <br />Districts. <br />INTRODUCTION: <br />The proposed addendum seeks to expand the scope of the draft ordinance regulating cannabis <br />businesses within Hugo by introducing the concept of Cannabis Agriculture Operations. This <br />amendment would allow Cannabis Microbusinesses and Mezzobusinesses to operate under a <br />Conditional Use Permit (CUP) within Agricultural (AG) and Future Urban Service (FUS) districts, <br />ensuring that cannabis cultivation and processing align with traditional farming practices while <br />preserving Hugo’s rural aesthetic and community values. <br />The Conditional Use Permit framework provides the city with a structured method for oversight <br />and regulation, ensuring compatibility with existing land uses and maintaining the small-town <br />character that defines Hugo. By adopting this addendum, Hugo would position itself as a <br />forward-thinking community, safeguarding its agricultural heritage while embracing innovative <br />farming practices. <br />PROPOSED AMENDMENTS TO THE DRAFT ORDINANCE: <br />1. Chapter 90, Article I, Section 90-1 – Definitions <br />Add the following definitions: <br />● Cannabis Agriculture: The cultivation, processing, and limited distribution of cannabis <br />plants and products by state-licensed Cannabis Microbusinesses and Mezzobusinesses, <br />regulated under the same standards and zoning practices as traditional agricultural <br />uses. Permitted as a Conditional Use within Agricultural (AG) and Future Urban Service <br />(FUS) districts, subject to specific performance standards. <br />● Cannabis Agriculture Operation: A state-licensed Cannabis Microbusiness or <br />Mezzobusiness engaged in Cannabis Agriculture, adhering to traditional agricultural <br />zoning, building codes, and land-use standards, and requiring Conditional Use Permit <br />(CUP) approval.
