The proposed zoning classification is appropriate for the property given the topographic, <br />environmental and cultural limitations of the site. <br /> <br />The buildings and site area arranged to accommodate the proposed use in regards to <br />parking, access, and building placement. The proposed zoning classification is <br />appropriate for the property because there are no topographic, environmental, or cultural <br />limitation of the site. <br /> <br />3. Existing public infrastructure is adequate to handle the development that can reasonably <br />be foreseen on the site <br /> <br />The property is adjacent and gets access from Rosemary Way. Rosemary Way is <br />designated as a Major Collector in the 2040 Comprehensive Plan. The property can be <br />adequately served with the accesses proposed. The property is served by city sewer and <br />water. <br /> <br />4. The proposed zoning classification will not have unreasonable negative impacts on <br />neighboring properties <br /> <br />The shopping center to the east is part of the Victor Gardens North mixed-use <br />development that includes commercial uses and multi-family housing. Proving the mix of <br />uses is consistent with the development in the area. The access is proposed on Rosemary <br />Way which is classified as a Major Collector road in the 2040 Comprehensive Plan. <br />Rosemary Way is designed to accommodate and has the capacity for additional traffic. <br /> <br />The proposed zoning will not have unreasonable negative impacts on the neighboring <br />properties. <br /> <br />5. The floodplain designation on the official zoning map shall not be removed from <br />floodplain areas unless it can be shown that the designation is in error or that the area <br />has been filled to or above the elevation of the regulatory flood protection elevation and <br />is contiguous to lands outside the floodplain. <br /> <br />No floodplain areas are proposed to be impacted with the project. <br /> <br />It is in staff’s opinion that all of the necessary requirements for approval of a zoning amendment <br />are met. <br /> <br />Conditional Use Permit <br /> <br />The developer is requesting an apartment use to be allowed on the property. Apartment <br />communities are allowed in the R-5 zoning district with a conditional use permit. <br />
