RESOLUTION 2024-XX <br />APPROVING A CONDITIONAL USE PERMIT FOR SCOTT AND LEANN NEAMY TO <br />CONSTRUCT AN ACCESSORY APARTMENT FOR THE PROPERTY LOCATED AT <br />17220 KEYSTONE AVENUE NORTH <br />WHEREAS, Scott and LeAnn Neamy have requested approval of a conditional use permit to allow <br />the construction of a 900 square foot building addition, to be used as an accessory apartment, at <br />the property located at 17220 Keystone Avenue North. <br />WHEREAS, the property is legally described as follows: <br />See Attached <br />WHEREAS, the Planning Commission has considered the request on September 26, 2024, at a <br />duly called a public hearing and recommends approval. <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF HUGO, MINNESOTA, that it should and hereby does approve the conditional use permit to <br />allow the construction of a 900 square foot building addition to be used as an accessory <br />apartment, subject to the following findings: <br />1. The use is permissible by law. <br />2. The spirit and intent of the ordinance is to allow for living facilities dedicated for the use <br />of persons living separately from others in the building, while maintaining a single- <br />family residence as the primary use of the property. The existing building has an area of <br />2,710 square feet, of which 1,798 square feet is occupied by the house. The proposed <br />building addition is approximately 900 square feet, so staff is considering its footprint to <br />be accessory to the existing building. The proposed building addition will not dominate <br />the appearance of the property or the house it is attached to. The requested accessory <br />apartment is keeping with the spirit and intent of the ordinance. <br />3. The use will not substantially alter the residential character of the property, which is a <br />typical use in areas that are zoned and guided as Agricultural. The City’s Comprehensive <br />Plan identifies this area as Agricultural. The proposed use is compatible with the City’s <br />comprehensive plan and the character of the surrounding area. <br />4. The proposed use has adequate drainage, water supply, and utilities. <br />5. The property has adequate road access from Keystone Avenue North. <br />6. The site is not located within a floodplain area and the project is not proposing any <br />impacts to floodplain. <br />7. The site is not located adjacent to the public waters.
