<br />8 <br /> <br />d. The renewal application does not meet the requirements <br />of this ordinance, or any other applicable rule or law. <br />e) Suspension of Registration <br />1. Violations – Any violation of this ordinance, or any applicable <br />rule or law, shall be deemed to be an administrative offense of the <br />registration holder, and the registration holder shall be subject to <br />the administrative penalties set forth in the city fee schedule for <br />cannabis businesses. <br />2. When Suspension is Warranted – The City of Hugo may suspend <br />a cannabis business registration, after notice and an opportunity <br />for hearing where reasonably available, if it violates a city <br />ordinance or poses an immediate threat to the health or safety of <br />the public. The city shall promptly notify the cannabis business in <br />writing the grounds for the suspension. <br />3. Notification to the state – The City of Hugo shall immediately <br />notify the state office of cannabis management in writing the <br />grounds for the suspension, who shall in turn provide the city and <br />cannabis business a response to the complaint within seven <br />calendar days, and perform any necessary inspections within 30 <br />calendar days. <br />4. Length of suspension – The suspension of a cannabis business <br />registration may be up to 30 calendar days, unless the state office <br />of cannabis management suspends the license for a longer period. <br />The business may not make sales to customers if their registration <br />is suspended. The city may reinstate a registration if it determines <br />that the violation(s) have been resolved. The city shall reinstate a <br />registration if the state office of cannabis management determines <br />that the violation(s) have been resolved. <br />5. Subject to Minn. Stat. 342.22 Subd. 5(e), the city may impose a <br />civil penalty, as specified in the city fee schedule, for registration <br />violations. The penalty shall not exceed $2,000. <br />f) Limiting of Retail Registrations -- the City of Hugo shall limit the <br />number of cannabis retail business registrations to one registration for every <br />12,500 residents. This limit shall include registrations for cannabis retail <br />businesses as licensed under Minn. Stat. 342.32, cannabis microbusinesses <br />with a retail operations endorsement as licensed under Minn. Stat. 342.28, <br />and cannabis mezzobusinesses with a retail operations endorsement as <br />licensed under Minn. Stat. 342.29. This limit shall not extend to lower- <br />potency hemp edible retailers, as licensed under Minn. Stat. 342.46, and <br />medical cannabis retailers, as licensed under Minn. Stat. 342.51. <br />3. Annual Compliance Checks – The City of Hugo shall complete at minimum one <br />compliance check per calendar year of every registered cannabis business that <br />conducts retail sales of products to customers or patients, to assess if the business <br />meets age verification requirements, as required under Minn. Stat. 342.22 Subd. <br />4(b) and Minn. Stat. 342.24. <br />4. Multiple license types – Subject to all applicable state law, and cannabis <br />licensing rules under Minn. Stat. Chapter 342, a cannabis business that holds more <br />than one license type can perform all activities for which they are granted a state -
