<br /> Page 1 of 5 <br /> <br /> <br /> <br />COOPERATIVE AGREEMENT BETWEEN THE CITY OF <br />HUGO AND WASHINGTON COUNTY FOR CONSTRUCTION COST OF <br />TRUNK HIGHWAY 61 THROUGH THE LOCAL PARTNERSHIP PROGRAM <br /> <br /> <br /> <br />THIS AGREEMENT, by and between the City of Hugo, a municipal corporation, herein after referred to as the <br />"City", and Washington County, a political subdivision of the State of Minnesota, hereinafter referred to as the <br />"County.” <br /> <br />WITNESSETH: <br /> <br />WHEREAS, the County, through the Minnesota Department of Transportation’s (MnDOT) Local Partnership <br />Program Grant, intends to construct improvements on Trunk Highway 61 from Egg Lake Road to Frenchman <br />Road in the City of Hugo; and <br /> <br />WHEREAS, Washington County will enter into a cooperative construction agreement with MnDOT to cover all <br />project costs associated with the project; and <br /> <br />WHEREAS, items included in the Project require City cost participation in accordance with MnDOT Cost <br />Participation Policy and previous maintenance agreements between MnDOT and the City of Hugo; and <br /> <br />WHEREAS, the City desires to use local funds and State Aid for these improvements; and <br /> <br />WHEREAS, the County desires to use local funds and State Aid for these improvements; and <br /> <br />WHEREAS, a cooperative effort between the City and County is the appropriate method to facilitate the <br />construction of these transportation improvements; and <br /> <br />WHEREAS, the project was awarded Local Partnership Program (LPP) Grant funding through MnDOT to cover a <br />portion of construction and construction engineering costs; and <br /> <br />WHEREAS, this Agreement is made pursuant to statutory authority contained in Minnesota Statute 162.17 sub.1 <br />and Minnesota Statute 471.59. <br /> <br />NOW THEREFORE, IT IS HEREBY MUTUALLY AGREED AS FOLLOWS: <br />A. PURPOSE <br />The purpose of this Agreement is set forth in the above whereas clauses which are all incorporated by <br />reference as if fully set forth herein and shall consist of this Agreement, Exhibit A (Location Map) and Exhibit <br />B (Estimated Cost Splits). <br /> <br />B. PLANS AND SPECIFICATION PREPARATION <br />1. The County shall be responsible for the preparation of all the plans and specifications for the Project, <br />including but not limited to, compliance with all applicable standards and policies and obtaining all <br />approvals required in formulating the bid specifications for all County and City components of this <br />Project. <br />2. The following County project number has been assigned to the Project: SAP 082-082-010-004. <br />3.
