<br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />EASEMENT AGREEMENT <br /> <br /> <br />This agreement, is made this _____ day of ________, 20_____, by and between the City of <br />Hugo, a Minnesota municipality (hereinafter “City") and Jacob Melquist, a single person, <br />(hereinafter "Owner"). <br /> <br />WHEREAS, the City is the owner of certain real property described on Exhibit A hereto <br />(the "City Property"); and <br /> <br />WHEREAS, _________________ is the owner of certain real property described on Exhibit B <br />hereto (the “Owner Property"); and <br /> <br />WHEREAS, the City Property is adjacent to the Owner Property; and <br /> <br />WHEREAS, the City has agreed to grant Owner a permanent access easement on a portion <br />of the City Property described in Exhibit C; and <br /> <br />WHEREAS, the City agrees to grant to Owner the permanent right to use the portion the <br />City Property for purposes of ingress and egress and a drivway; and <br /> <br />NOW THEREFORE, in consideration of the premises and for good and valuable <br />consideration, the receipt of which is hereby acknowledged, the parties agree as follows: <br /> <br />1. Recitals. The recitals contained above are true and correct and are <br />incorporated herein by reference. <br /> <br />2. Grant of Use to Owner for Ingress and Egress Purposes. The City does <br />hereby grant to Owner the permanent ingress and egress easement on the <br />property described on Exhibit A (the “City Property”), for the purpose of an <br />access driveway.
