172981943v5 <br /> <br /> <br /> 24 <br /> <br />or incur other expenses for the collection of amounts due hereunder or the enforcement of <br />performance of any obligation or agreement on the part of the Borrower, the Borrower will on <br />demand pay to the City or the Lender the reasonable fees and costs of such attorneys and such <br />other expenses so incurred. <br />Section 6.6 Effect of Waiver. In the event any agreement contained in this Agreement <br />should be breached by either party and thereafter waived by the other party, such waiver shall be <br />limited to the particular breach so waived and shall not be deemed to waive any other breach <br />hereunder. The Lender shall not be deemed, by any act of omission or commission, to have waived <br />any of its rights or remedies hereunder unless such waiver is in writing and signed by the Lender <br />and, then only to the extent specifically set forth in the writing.
