The Contractor must cease all work and notify the Railway immediately before continuing <br />excavation in the area if obstructions are encountered which do not appear on drawings. If <br />the obstruction is a utility and the owner of the utility can be identified, then the Contractor <br />must also notify the owner immediately. If there is any doubt about the location of <br />underground cables or lines of any kind, no work must be performed until the exact location <br />has been determined. There will be no exceptions to these instructions. <br /> <br />C. All excavations must be conducted in compliance with applicable OSHA regulations and, <br />regardless of depth, must be shored where there is any danger to tracks, structures or <br />personnel. <br /> <br />D. Any excavations, holes or trenches on the Railway's Property must be covered, guarded <br />and/or protected when not being worked on. When leaving work site areas at night and <br />over weekends, the areas must be secured and left in a condition that will ensure that <br />Railway employees and other personnel who may be working or passing through the area <br />are protected from all hazards. All excavations must be back filled as soon as possible. <br /> <br />E. Excavations and restoration must be conducted in accordance with all applicable Legal <br />Requirements and the environmental provisions of Section 8. <br /> <br />F. All fill materials to be imported to Railway’s property shall be certified clean fill or from a <br />Railway-approved source, and must otherwise be suitable for its intended purpose as <br />backfill material. Supporting documentation shall be provided to Railway upon request. <br /> <br />G. Contractor must meet the appropriate compaction requirements for all fills and will be <br />responsible for settlement of all fills, erosion, and embankments that may occur as a result <br />of the placement fill. <br /> <br /> <br />8) Environmental Requirements: <br /> <br />A. Contractor must comply with all Environmental Laws (as defined below). Contractor must <br />not maintain a "treatment," "storage," "transfer" or "disposal" facility, or "underground <br />storage tank," as those terms are defined by Environmental Laws, on the Railwa y Property <br />or the right of way. Contractor will not handle, transport, release or suffer the release of <br />Hazardous Materials (as defined below). <br /> <br />B. If Contractor discovers any hazardous waste, hazardous substance, petroleum or other <br />deleterious material, including but not limited to any release of Hazardous Materials <br />non-containerized commodity or material, on or adjacent to Railway's Property, in or near <br />any surface water, swamp, wetlands or waterways, while performing any work under this <br />Agreement, Contractor must immediately: (a) notify the Railway's Resource Operat ions
