Kwik Trip – 159th Street <br />Page 6 <br />The property is adjacent to and is accessible from 159th Street, which is designated as a <br />Minor Collector in the 2040 Comprehensive Plan. The property can be adequately served <br />with the accesses proposed. The property is served by city sewer and water. <br /> <br />4. The proposed zoning classification will not have unreasonable negative impacts on <br />neighboring properties <br /> <br />The property is immediately adjacent to commercially-zoned property, and across 159th <br />Street from residentially-zoned property. The proposed zoning classification will buffer <br />noncompatible uses with the street between them, thus minimizing the impact on <br />neighboring properties. The access is proposed on 159th Street which is classified as a <br />Minor Collector road in the 2040 Comprehensive Plan. 159th Street is designed to <br />accommodate and has the capacity for additional traffic. <br /> <br />The proposed zoning will not have unreasonable negative impacts on the neighboring <br />properties. <br /> <br />5. The floodplain designation on the official zoning map shall not be removed from floodplain <br />areas unless it can be shown that the designation is in error or that the area has been filled <br />to or above the elevation of the regulatory flood protection elevation and is contiguous to <br />lands outside the floodplain. <br /> <br />No floodplain areas are proposed to be impacted with the project. <br /> <br />It is in staff’s opinion that all of the necessary requirements for approval of a zoning amendment <br />are met. <br /> <br />Conditional Use Permit <br /> <br />The developer is requesting a carwash use to be allowed on the property, and for the gas station <br />and convenience store to operate 24 hours per day, both of which uses are allowed in the C -2 <br />zoning district with approval of a conditional use permit. <br /> <br />The Planning Commission must review the application for a conditional use permit with the <br />standards provided in Section 90-37 of the City Code. Staff used these standards to review the <br />application and found that the request meets all applicable standards as follows: <br /> <br />1. The proposed use is permissible by law. <br /> <br />The proposed uses are allowed by conditional use permit. <br /> <br />2. The proposed use is keeping with the spirit and intent of the ordinance. <br /> <br />The proposed uses are allowed in the C-2 zoning district with a CUP, and will keep with the <br />spirit and intent of the ordinance. The carwash and 24-hour operation are conditional uses since <br />they have the potential to generate a greater impact on any adjacent noncompatible uses. 159th <br />Street creates an adequate buffer between the proposed commercial site and the residential
