<br />: <br /> Page 25 <br />The employee’s supervisor must approve overtime hours in advance. An employee who works <br />overtime without prior approval will be subject to disciplinary action. <br /> <br />The City’s workweek begins at 12:00 a.m. on Monday and ends at 11:59 p.m. on Sunday. <br /> <br />Non-Exempt (Overtime-Eligible) <br /> <br />Employees to whom the Fair Labor Standards Act applies shall be compensated at the rate of <br />time-and-one-half for all hours worked over 40 in one workweek. PTO does not count toward <br />“hours worked.” Hours paid for Holiday Leave shall be considered as hours worked to determine <br />overtime. Compensation will take the form of either time-and-one-half pay or compensatory <br />time. Compensatory time is paid time off at the rate of one-and-one-half hours off for each hour <br />of overtime worked. When converting annual pay rates into hourly pay rates for the purpose of <br />computing overtime, the annual rate shall be divided by 2,080 hours. <br /> <br />• Regular Full-Time Non-Exempt Employees <br />Regular full-time non-exempt employees in departments other than public works will <br />receive compensatory time for any excess hours, with a cap of 40 hours for accrued <br />compensatory time. At the discretion of the Department Head and based on the <br />employee’s request, overtime may be used to compensate for unusual circumstances. <br />Employees can earn and accrue compensatory time up to this cap. Employees who have <br />reached the cap will be required to take compensatory time before using personal time. <br />The City reserves the right to pay down or pay off, with cash payments, an employee’s <br />accrued compensatory time, regardless of the amount, at the employees’ regular rate of <br />pay. Salaried employees shall not receive pay from the City in excess of their authorized <br />salaries, except as may be approved by the City Administrator. <br /> <br />• Public Works Employee Overtime <br />Full-time public works employees will be given the choice to receive overtime (cash <br />payment) or compensatory time (time off) for any excess hours over 40 worked in the <br />week. The employee will record his/her choice on the timesheet. Part-time and seasonal <br />public works employees will receive overtime for any excess hours. Overtime will be <br />earned at a rate of one and one-half times the employee’s regular rate of pay. <br />Compensatory time will be earned at a rate of one and one-half hours for each excess <br />hour. A cap of 120 hours for accrued compensatory time is established. Cash (overtime) <br />payments will be used after an employee has reached the cap. The City reserves the right <br />to pay down or pay off, with cash payments, an employee’s accrued compensatory time, <br />regardless of the amount. An employee may be granted paid overtime in lieu of <br />compensatory time off at the discretion of the Department Head. <br /> <br />• Public Works Employee On-Call <br />All regular, full-time public works department employees who are required to be on-call <br />(standby) shall be compensated at a rate set by the City Council annually. Employees <br />responding to a callout outside normal working hours shall receive a minimum of two (2)
