<br />: <br /> Page 44 <br /> <br />Typically, employee benefits will not be earned by an employee while on leave without pay. <br />However, the City’s contribution toward health, dental and short-term disability insurance may <br />be continued, if approved by the City Council, for leaves of up to ninety days when the leave is <br />for medical reasons and FMLA has been exhausted. <br /> <br />Leave without pay hours will not count toward seniority and all accrued Personal and <br />Compensatory Time must normally be used before an unpaid leave of absence will be approved. <br />An employee need not have used all ESST earned unless the leave is for applicable reasons. <br /> <br />Unless required by law, an unpaid leave of absence does not guarantee a return to the <br />employee’s original position. If their original position or a position of similar or lesser status is <br />available, it may be offered at the discretion of the City Administrator subject to approval of the <br />City Council. <br /> <br />Section 11.25 Leave of Absence for Firefighters <br /> <br />Requests for leave of absences shall be granted to on-call firefighters to maintain their health <br />and well-being. All requests shall be submitted in writing directly to the City Administrator for <br />interim approval; final approval shall be made by the City Council upon review of the request and <br />the opportunity to request supplementary information or documentation supporting the <br />request. A Leave of Absence Request Form is herein attached as Appendix F. The firefighter <br />requesting leave shall comply with all requests for additional information or documentation, <br />unless the requests would otherwise be a violation of contract, policy or procedure, or State or <br />Federal law. Firefighters requesting leave must identify whether full or partial leave is requested. <br />A partial leave allows a firefighter to attend training to maintain required certifications. <br /> <br />In an effort to minimize any impact on the operations of the Fire Department or services provided <br />to the citizens of Hugo, the City Administrator shall immediately contact the Fire Chief and inform <br />him/her of any request for leave and the status of approval. At all times, the Fire Chief shall <br />remain informed as to the state of the request and the terms under which final approval may <br />have been granted. Below are conditions for personal, medical, and military leave requests: <br /> <br />a. Personal Leave <br />A request for personal leave may be submitted in order to attend to family or personal <br />needs. As referenced above, all requests for personal leave shall be submitted in writing <br />directly to the City Administrator for interim approval; final approval shall be made by the <br />City Council upon review of the request and the opportunity to request supplementary <br />information or documentation supporting the request. <br /> <br />Personal leave shall not extend beyond two (2) months. While on leave, on-call <br />firefighters are exempt from emergency responses and training percentages and may not <br />respond to calls. It is highly recommended for employees on partial leave to participate
