<br />: <br /> Page 50 <br />In accordance with federal law, the City of Hugo has adopted the following policy on drugs in the <br />workplace: <br />a. Employees are expected and required to report to work on time and in appropriate <br />mental and physical condition. It is the City’s intent and obligation to provide a drug- <br />free, safe and secure work environment. <br />b. The unlawful manufacture, distribution, possession, or use of drugs on City property <br />or while conducting City business is absolutely prohibited. Violations of this policy will <br />result in disciplinary action, up to and including termination, and may have legal <br />consequences. <br />c. The City recognizes drug abuse as a potential health, safety, and security problem. <br />Employees needing help in dealing with such problems are encouraged to use their <br />health insurance plans, as appropriate. <br />d. Employees must, as a condition of employment, abide by the terms of this policy and <br />must report any conviction under a criminal drug statute for violations occurring on <br />or off work premises while conducting City business. A report of the conviction must <br />be made within five days after the conviction as required by the Drug-Free Workplace <br />Act of 1988. <br />Section 18.01 Additional Firefighter Provisions <br /> <br />a. The Hugo Fire Department maintains a zero-tolerance policy regarding the use of alcohol <br />and/or drugs while participating in Fire Department functions including: <br />• response to fire and other emergency incidents <br />• participation in Fire Department training activities <br />• participation in any other activities where the firefighter is serving as a <br />representative of the Fire Department <br /> <br />b. If a firefighter has consumed any substance that may impair physical activity or mental <br />judgement, the firefighter shall not respond to an emergency incident and shall not <br />participate in training or any other Fire Department activity. This specifically includes but <br />is not limited to: <br />• consumption of any alcohol within an eight-hour period or is still impaired by <br />alcohol consumed over eight hours ago. <br />• being under the influence of any illegal drugs. <br />• recent use of any prescription or non-prescription medication which is labeled <br />with a warning regarding drowsiness, driving, or operation of machinery, unless a <br />physician has certified that the firefighter can safely and properly perform the <br />duties of a firefighter. <br /> <br />Section 18.02 Additional Commercial Drivers Provisions <br />
