. . ` `. . <br /> , <br /> 130-10 6 <br /> 130-10. REPORT OF SPILLS. It is the duty of every Person to notify the <br /> . Minnesota Pollution Control Agency of any spill or discharge of a <br /> substance in accordance with Minnesota Statute, Section 115.061 . <br /> Any Person holding a Junk Yard or Auto Dismantling License from <br /> the City of Hugo shall also report to the City of Hugo, in <br /> writing , the time, date, location , cause, and method of clean-up <br /> of any hazardous-material spill in excess of one gallon in <br /> volume, which occurs on the premises of the Licensee, within 48 <br /> hours of the occurrence of the spill . <br /> 130-11 . TERM OF LICENSES. Licenses shall be issued under this ordinance <br /> for a period not to exceed two years. <br /> 130-12. DISPLAY NSE. Every License shall be kept conspicuously <br /> posted about the place for which it is issued , along with the <br /> telephone numbers of the Minnesota Pollution Control Agency Spill <br /> Unit and the Hugo Fire Department. Licenses shall be exhibited <br /> to any Person upon request. <br /> 130-13. . The fee for every Junk Yard and Auto Dismantling <br /> Facility License shall be $125.00 per year, plus actual <br /> site-inspection , sampling , and analysis fees not to exceed $6,000 | <br /> annually . Such fees do not include costs to be paid by the <br /> licensee in the design , supervision , and construction of any <br /> ground water monitoring wells required as part of this license. <br /> 1 <br /> - \ 130-14. REVOCATION. Every License may be revoked by the Council for <br /> violation of any provision of this Ordinance, after the Licensee <br /> has been given reasonable notice and the opportunity to be heard , <br /> or upon any change in zoning or special use permit status of the <br /> premises whereby Junk Yard or Auto Dismantling Facilities are <br /> prohibited . There shall be no refund of any License fee, <br /> • inspection fee, or any portion thereof upon revocation . <br /> 130-15. PENALTIES. Any person who violates any provision of this <br /> ordinance shall be guilty of a misdemeanor. <br /> 130-16. EFFECTIVE DATE. This Ordinance will become effective from and <br /> after its adoption and publication . <br /> Upon roll call , the following members voting AYE: Barnes, Brunotte, <br /> Leroux , Miron <br /> ABSTAINED: Stoltzman <br /> Whereupon said ordinance was declared passed and adopted this 1st day of <br /> March, 1993. <br /> Walter L.
