CITY OF HUGO <br />WASHINGTON COUNTY, MINNESOTA <br />ORDINANCE NO. 2001 - 347 <br />AN ORDINANCE AMENDING CHAPTER 320 (ZONING ORDINANCE) OF THE CITY <br />CODE BY DELEGATING TO THE PLANNING COMMISSION CERTAIN <br />RESPONSIBILITIES TO REVIEW VARIANCES AND CHANGING THE QUORUM FROM <br />THREE TO FOUR VOTING MEMBERS <br />(Seventh Amendment to Chapter 320) <br />THE CITY OF HUGO ORDAINS: <br />Section 1. Amendment of CitCod e. Hugo City Code, Chapter 320, Section 8.3 is hereby <br />deleted in its entirety and replaced with the following: <br />8.3 Planning Commission. The Planning Commission shall serve as advisors to the City <br />Council by preparing and making recommendations regarding the appropriateness of the City's <br />Comprehensive Plan, Zoning Ordinance, Subdivision Regulations, and such other matters that <br />impact the orderly and efficient development of the community. The Planning Commission shall <br />act only as a body sitting in open session duly noticed, as required by law. The Planning <br />Commission may appoint subcommittees or individuals to prepare polices, findings, and reports <br />for consideration by the entire Commission at a regular meeting thereof. <br />A. The Planning Commission shall consist of seven (7) persons, all residents of the City <br />and eligible voters, appointed by the City Council for staggered four -(4) year terms. The City <br />Attorney, City Engineer, and City Health Officer, or their representatives, may serve as non- <br />voting, ex -officio members upon request of the Commission. Terms of office shall be staggered <br />such that no more than two (2) voting members' terms shall expire in any one (1) year. <br />B. A quorum of the Planning Commission shall consist of four (4) voting members, and <br />it shall require the affirmative vote of a majority of the Planning Commissioners present (so long <br />as there is a quorum) to approve any motion, resolution, or other official action. <br />C. Commission officers shall include a Chairperson, a Vice Chairperson, and a secretary, <br />all appointed annually by the City Council. The secretary need not be a member of the Planning <br />Commission. The Chairperson and Vice Chairperson have full voting rights and need not limit <br />their votes to cases of a tie. <br />D. Planning Commissioners may be removed from office by the City Council for: <br />1) Changing their place of residence to a location outside the corporate <br />boundaries of the City, or otherwise not meeting the requirements for office. <br />2) Failure to perform their official duties, including not attending called and <br />noticed meetings. <br />
