PRINTER'S AFFIDAVIT OF PUBLICATION <br />CITY OF HUGO <br />WASHINGTON COUNTY, MINNESOTA <br />ORDINANCE NO. 2001-347 <br />ORDINANCE AMENDING CHAPTER 320 <br />(ZONING ORDINANCE) OF THE CITY CODE <br />BY DELEGATING TO THE PLANNING <br />COMMISSION CERTAIN RESPONSIBILITIES <br />TO REVIEW VARIANCES AND CHANGING <br />THE QUORUM FROM THREE TO FOUR <br />VOTING MEMBERS <br />(SEVENTH AMENDMENT TO CHAPTER 320) <br />THE CITY OF HUGO ORDAINS: <br />Section 1. Amendment of City Code Hugo <br />City Code, Chapter 320, Section 8.3 is hereby <br />deleted in its entirety and replaced with the fol- <br />lowing: <br />8.3 Planning Commission The Planning <br />Commission shall serve as advisors to the City <br />Council by preparing and making recommenda- <br />tions regarding the appropriateness of the City's <br />Comprehensive Plan, Zoning Ordinance, <br />Subdivision Regulations, and such other matters <br />that impact the orderly and efficient development <br />of the community. The Planning Commission <br />shall act only as a body sitting in open session <br />duly noticed, as required by law. The Planning <br />Commission may appoint subcommittees or <br />individuals to prepare polices, findings, and <br />reports for consideration by the entire <br />Commission at a regular meeting thereof. <br />A. The Planning Commission shall consist of <br />seven (7) persons, all residents of the City and <br />eligible voters, appointed by the City Council for <br />staggered four -(4) year terms. The City Attorney, <br />City Engineer, and City Health Officer, or their <br />representatives, may serve as non-voting, ex - <br />officio members upon request of the <br />Commission. Terms of office shall be staggered <br />-. -h that no more than two (2) voting members' <br />ns shall expire in any one (1) year. <br />B. A quorum of the Planning Commission <br />shall consist of four (4) voting members, and it <br />shall require the affirmative vote of a majority of <br />the Planning Commissioners present (so long as <br />there is a quorum) to approve any motion, reso- <br />lution, or other official action. <br />C. Commission officers shall include a <br />Chairperson, a Vice Chairperson, and a secre- <br />tary, all appointed annually by the City Council. <br />The secretary need not be a member of the <br />Planning Commission. The Chairperson and <br />Vice Chairperson have full voting rights and <br />need not limit their votes to cases of a tie. <br />D. Planning Commissioners may be <br />removed from of office by the City Council for; <br />1) Changing their place of residence to a <br />location outside the corporate boundaries of the <br />City, or otherwise not meeting the requirements <br />for office. <br />2) Failure to perform their official duties, <br />including not attending called and noticed meet- <br />ings. <br />3) Behavior disruptive to the good order and <br />efficiency of the Commission. <br />4) Moral turpitude. <br />E. Vacancies on the Planning Commission <br />shall be filled by the City Council as soon as <br />practical after the vacancy occurs, and such <br />appointments shall be made for the unexpired <br />portion of the vacated term. <br />F The Planning Commission may adopt <br />such other rules of order as it deems necessary <br />for the efficient conduct of its responsibilities. <br />G. Planning Commission responsibilities <br />1) To study, report, and make recommenda- <br />tions on amendments to the City's <br />Comprehensive Plan and land use regulations. <br />2) To conduct hearings and make recom- <br />ndations regarding the issuance of <br />onditional Use Permits. <br />3) To conduct hearings and make recom- <br />mendations regarding requests for rezoning. <br />4) To conduct hearings and make recom- <br />mendations regarding the subdivision and plat- <br />ting of property <br />5) To review and make recommendations on <br />commercial and industrial site plans. <br />6) To review and make recommendations on <br />,riances associated with site plans, preliminary <br />its, and conditional use permits. <br />7) Perform such other duties as the <br />Council may, from time to time, prescribe. <br />Section 3. Effective Date.
