<br /> <br /> <br /> Created: 2025-05-22 16:40:52 [EST] <br />(Supp. No. 36) <br /> <br />Page 101 of 198 <br />(l) Excavation, fill, or grading permits are not required for basement construction done in accordance with <br />approved site development plans. <br />(m) The requirement for an excavation, fill, or grading permit may be waved by the city council for mining <br />operations conducted under a mining permit. <br />(n) A cash escrow or letter of credit shall be provided by the applicant for an excavation, fill, or grading permit in <br />an amount not less than $2,000.00, or $1,000.00 per acre, whichever is higher, to guarantee performance <br />under the permit. Where a cash escrow or letter of credit is provided to another governmental agency to <br />guarantee the work being performed under the permit, and the amount deposited with the other <br />governmental agency is equal to the requirements of this section, the requirement for escrow to be posted <br />with the city may be waived by the city building official. <br />(Prior Code, § 1175-120.1) <br />Sec. 90-179. Heritage preservation. <br />No excavation, fill, or construction shall be performed on any significant historic site in any manner that <br />affects the historic value of the site prior to preparation of an inventory and analysis of the site being prepared by <br />a professional historian or archeologist. The inventory and analysis shall be deposited with the state historical <br />society or other suitable repository approved by the city council. <br />(Prior Code, § 1175-125.1) <br />Sec. 90-180. Pipeline setbacks. <br />No building or place of public assembly shall be constructed or altered to be nearer to a substantial pipeline <br />than the boundary of the pipeline easement, as legally established at the time of issuance of any building permit, <br />or the commencement of any construction. For the purposes of this section, the term "building" shall not include <br />appurtenances required to operate or maintain pipeline systems. <br />(Prior Code, § 1175-135.1) <br />Sec. 90-181. Salt storage at commercial, industrial, and institutional facilities. <br />(a) Definitions. The following words, terms, and phrases, when used in this section, shall have the meanings <br />ascribed to them in this subsection, except where the context clearly indicates a different meaning: <br />(1) Anti-icing means the application of a liquid deicer prior to the onset of a snow event. <br />(2) Deicer means a substance used to melt snow and ice or used for its anti-icing effects. <br />(b) Storage of deicing materials. <br />(1) Indoor operations for the storage of deicing materials must be provided whenever possible in order to <br />prevent such material from being affected by rain, snow, or melt water. <br />(2) All salt, sand, and other deicing materials stored outdoors must be located on impervious surfaces and <br />be covered at all times. When not using a permanent roof, a waterproof impervious, flexible cover <br />must be placed over all storage piles. The cover must prevent runoff and leachate from being <br />generated by the outdoor storage piles. The cover must be secured to prevent removal by wind or <br />other storm events. Piles must be formed in a conical shape and covered as necessary to prevent <br />leaching.
