<br /> <br /> <br /> Created: 2025-05-22 16:40:53 [EST] <br />(Supp. No. 36) <br /> <br />Page 137 of 198 <br />(g) The following lighting mechanisms are exempted from the provisions of this chapter not relating to public <br />safety: <br />(1) Temporary holiday lighting used during customary holiday seasons. <br />(2) Civic event lighting approved by the city council. <br />(3) Airport lighting required for the safe operation of aircraft. <br />(4) Safety lighting required by federal, state, or local law, ordinance, or regulation. <br />(h) Measurements shall be taken after dark with the light meter held six inches above the ground with the meter <br />facing the light source. A reading shall be taken with the light source on, then with the light source off. The <br />difference between the two readings is the illumination intensity. <br />(i) Outside lighting shall not be located within a shoreland impact area or over public waters unless it is utilized <br />to illuminate potential safety hazards and shielded to prevent illumination across public waters. This does <br />not preclude the use of navigational lights, where required. <br />(Prior Code, § 1195-400.1, § 90-239) <br />Sec. 90-239. Liquor and alcohol uses (brewpubs, wineries, distilleries, etc.). <br />(a) It is unlawful for any person to produce or sell liquor or any alcohol anywhere in the city, except in <br />conformance with this chapter. <br />(b) Uses must comply with all regulations of chapter 6 article II, Division 2 of the city code regarding alcoholic <br />beverages and licenses. <br />(c) The following shall apply to brewpubs, breweries, wineries, distilleries, taprooms, tasting rooms, and cocktail <br />rooms whether permitted, conditional, or accessory: <br />(1) In industrial zoning districts, the floor area of taprooms, brewpubs, tasting rooms, cocktail rooms and <br />wineries may be used for retail sales of associated products provided the retail floor area does not <br />exceed 20 percent of the gross floor area. <br />(2) Outdoor seating is permitted provided the area of the seating does not exceed 35 percent of the floor <br />area used for retail or indoor seating. <br />Sec. 90-240. Livestock and poultry. <br />(a) It is unlawful for any person to keep or maintain any animal, domestic or nondomestic, in the city, except in <br />conformance with the requirements of this section. <br />(b) Domestic livestock and poultry may be kept or maintained in the agricultural, long-term agricultural, future <br />urban service, and rural residential zoning districts on parcels of land of five acres or more in size. Two <br />animal units shall be allowed for the first five acres of land, and one additional animal unit shall be allowed <br />for each acre of land in excess of five acres. On parcels of land less than five acres in the agricultural, long- <br />term agricultural, future urban service, and rural residential zoning districts, up to five chickens may be kept <br />or maintained, none of which may be roosters. For the purposes of this subsection (b), the following <br />conditions shall apply: <br />(1) Adjacent parcels of land under common ownership may be combined to determine the maximum <br />number of animal units allowed, if the parcels are operated as a single enterprise. <br />(2) In instances where a parcel of land consists of a fraction of an acre, the property size shall be rounded <br />down to the nearest whole number to determine the number of animal units allowed.
