Warehouses. <br />(a) It is unlawful for any person to construct, operate, or maintain a warehouse and distribution facility in the <br />city, except in conformance with this chapter. <br />(b) Retail sales of products stored on site may be allowed as an accessory use from permitted warehousing and <br />distribution facilities as long as the retail sales area does not occupy more than 20 percent of the building’s <br />floor area. <br />(c) Exteriors of all principal and accessory buildings shall be of architecturally enhanced concrete panel, <br />architecturally enhanced masonry block, exterior insulation and finish system (EIFS), brick, dressed stone, or <br />glass. Colors shall be neutral or earth tones, except to create a decorative effect, 20 percent of the building <br />facade (excluding window and door areas from the computation) may be decorated with glazed tile, glass, <br />plastic or metal panels, or wood of various colors. <br />(d) Storage of explosive or hazardous waste in warehouses is allowed by an additional conditional use permit <br />with the proper authorization from applicable County, State, or Federal agencies. <br />(Prior Code, § 1195-700.1, § 90-269) <br />Sec. 90-266. Water-oriented accessory structure. <br />(a) It is unlawful for any person to construct or expand any water-oriented accessory structure, except under a <br />permit issued in accordance with chapter 14 of this Code, and the following conditions: <br />(1) Stairways, fences, docks, and retaining walls may be constructed between the ordinary high-water <br />level of a water feature and the building setback line for shoreland areas as allowed by section 90-137. <br />(2) In addition to those structures allowed by section 90-137(1), each lot or parcel of land within the <br />shoreland overlay district may have one water-oriented accessory structure not meeting the normal <br />structure setback from the ordinary high-water level found in section 90-137, so long as the structure <br />complies with all of the following: <br />a. On a natural environment lake and all rivers, the structure or facility must not exceed ten feet in <br />height, exclusive of safety rails, and cannot occupy an area greater than 250 square feet. On <br />general development and recreational development waterbodies, water-oriented accessory <br />structures used solely for watercraft storage, including storage of related boating and water- <br />oriented sporting equipment, may occupy an area up to 400 square feet, with a maximum width <br />of 20 feet, as measured parallel to the shoreline. <br />b. Detached decks must not exceed eight feet above grade at any point. <br />c. The setback of the structure or facility from the ordinary high-water level must be at least ten <br />feet. <br />d. The structure or facility must be treated to reduce visibility as viewed from public waters and <br />adjacent shorelands by vegetation, topography, increased setback or color, assuming summer <br />leaf conditions. <br />e. The structure or facility may not be used for human habitation, and must not contain a water <br />supply or sewage treatment facility.
