RESOLUTION 2013-14 <br />APPROVING A VARIANCE FROM THE BUILDING HEIGHT REQUIREMENTS IN <br />THE MEDIUM DENSITY MUTIPLE FAMILY RESIDENITIAL (R-5) ZONING <br />DISTRICT FOR CHIRST LUTHERAN CHURCH ON THE PROPERTY LOCATED AT <br />4970 ROSEMARY WAY NORTH <br />WHEREAS, Christ Lutheran Church has requested approval of a variance to allow a building to <br />be 41 feet in height, where 35 feet is required by ordinance for the property legally described as <br />follows: <br />Lots 1 and 2, Block 2, Frenchman Place <br />WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing <br />on April 25, 2013, and recommends approval and; <br />NOW, THEREFORE, BE IT HEREBY RESOVLED BY THE CITY COUNCIL OF THE CITY <br />OF HUGO, MINNESOTA, that it should and hereby does approve the request by Christ <br />Lutheran Church a variance to allow a building to be 41 feet in height, where 35 feet is required <br />by ordinance based on the following findings: <br />1. The proposed variance is permissible by law. <br />2. The cross is the only area where the building exceeds the height requirements and it is typical for <br />crosses to be higher than the building for identification. <br />3. The applicant is requesting to use the property in a reasonable manner. <br />4. The property is uniquely located in an area that is in close proximity to several power poles and <br />lines that run through the site to the northeast of the proposed building and in front of the <br />property. The poles are an average height of 40-50 feet in height in that location. The cross on the <br />top of the building will likely blend in with the power poles. <br />5. The proposed use is compatible with the surrounding development and will not alter the character <br />of the area. <br />6. The granting of the variance will keep with the spirit and intent of the ordinance. <br />7. A church is allowed in the Medium Density Multiple Family Residential (R-5) district with <br />approval of a conditional use permit. <br />8. The property is not located within a floodplain. <br />9. The property is served with municipal sewer and water. <br />
