RESOLUTION 2013 - 21 <br />RESOLUTION DECLARING ADEQUACY OF PETITION ADOPTING ASSESSMENT <br />FOR THE ROSEMARY WAY IMPROVEMENT PROJECT <br />WHEREAS, pursuant to proper notice duly given as required by law or waived, the <br />council has met and heard and passed upon all objections to the petition and proposed <br />assessment for the construction of Rosemary Way between the western boundary of the <br />Frenchman Place 1st Addition Plat and Everton Avenue North. <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />HUGO, MINNESOTA: <br />The Petition dated March 7, 2013 is hereby declared to be signed by the required <br />percentage of owners of property affected thereby and is declared to be adequate and the project <br />is ordered. Such proposed assessment, is hereby accepted and shall constitute the special <br />assessment against the lands named therein, and each tract of land therein included is hereby <br />found to be benefited by the proposed improvement in the amount of the assessment levied <br />against it. <br />2. Such assessment shall be as set forth in the Petition and Waiver Agreement, a <br />copy of which is attached hereto as Exhibit A. <br />3. The clerk shall forthwith transmit a certified duplicate of this assessment to the <br />county auditor to be extended on the property tax lists of the county. Such assessments shall be <br />collected and paid over in the same manner as other municipal taxes. <br />
