RESOLUTION 2015-19 <br />APPROVING A VARIANCE TO ALLOW CONSTURCTION OF A HOUSE <br />ABOVE THE MAXIMUM STRUCTURE HEIGHT ON HORSESHOE LAKE <br />FOR PROPERTY LOCATED SOUTH OF 174TH ST AND GREYSTONE <br />AVENUE NORTH <br />WHEREAS, Christopher and Tonic Johnson, have requested a variance is to allow a <br />building height of 35 feet, where 25 feet is required by the ordinance on the property legally <br />described as: <br />(See attached) <br />WHEREAS, the Board of Zoning Adjustments and Appeals has reviewed the variance at <br />a duly called public hearing on Thursday, April 2, 2015; and recommended approval, and; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF HUGO, MINNESOTA, that it should and hereby does approve the variance <br />request to construct a house with a maximum height of 35 feet, where 25 feet is required <br />by ordinance, with the following findings: <br />1. The requested variance is from the dimensional requirement of the ordinance and <br />is permissible'by law. <br />2. Because of circumstances unique to the property there are practical difficulties on <br />meeting the ordinance. <br />3. The granting of the variance would be in keeping with the spirit and intent of the <br />ordinance. <br />4. The applicant is proposing to use the property in a reasonable manner and <br />construction of a house is allowed in the FUS zoning district. <br />The proposed variance would not alter the character of the area. <br />Houses area permitted use in the FUS District, <br />The subject property is not within a floodplain. <br />8.
